Pensioners pending matters & 1st Pension credit invariably ,little quality efforts to pay results with ease

Dear Sri RKSahni,

1) I tried today some time before, got the line of MD Sri Mukesh Kumar Gupta,spoke to his PA , wished her Happy New Year & Divine Sankaranthi & to give me connection . Alas, he is in Nepal 
I told her normally fup & tracing free time for our grievances of pensioners , it consumes 4-5 hrs & so requested her to give me the connection
the moment he is back & resumes work before ,as she picturised a series of meetings lined up , bapre 

2) Then I wanted to pursue few OS points & Mediclaim with MD Sri TCSuseelKumar & to convince him that all efforts for their compliance to ensure Pensioners positively get credit from their Bank, after RBI Notification that from
16December 2019, All payments have to be accounted by all banks thro 24/7 NEFT round the clock & credited to recipients bank account on 1st itself irrespective of any Holiday could not fully click or materialize ,as some LIC DOs OS PCell
Could succeed while many failed 
So concerted action is needed thro effective Supervisory controls & Advance Advisory to all RMOS & DO SDM & Mgr OS
  But his PA informed he is on tour & back on

Same plea I made to her also to contact me before MD starts his work or for meetings etc She agreed 
I definitely greeted her for the New Year & Sakaranthi & even requested her to pray for all Pensioners, aged & mature , welfare & prosperity 
She was too glad

Dear Sir,
                                   Re: Amendment needed to Rule 54 of LIC(Employees) Pension Rules 1995
Kindly find forwarded a mail sent by me to the Executive Director(Personnel),LIC of India,Central Office on the above subject.
The Rule 54 of the cited Rules provide as follows:
" Manner of payment of pension -A pension fixed at a monthly rate shall be payable monthly on or after the first day of the following month."
It has been the experience of the LIC pensioners across the country,that many a month,the monthly pension is not credited on the 1st of the following month.Whenever it is a Sunday or holiday,the pensioner has to wait for pension credit to his/her account beyond the 1st of the month.It has been recently directed by the Reserve Bank of India that NEFT transactions should be put through irrespective of whether it is a holiday or not.
The above  open-ended Rule which is existing in the notified LIC Pension Rules continues for more than 24 years providing a lee-way to LIC to delay pension credit to pensioners' bank accounts beyond the first of the month.The words 'or after' appearing in the above Rules rob the Pension Rules of the accountability of LIC to pay pension on the due date.Delay in credit of pension beyond 1st causes undue hardship for pensioners.
I have therefore suggested to LIC to initiate amendment of the above Rule by deleting the words 'or after' so that LIC can adhere to the mandatory due date of 1st of the following month for payment of pension.
As the necessary power to amend the Pension Rules 1995 are vested in the Central Government by virtue of Section 48 of LIC Act 1956,I humbly request you to take immediate necessary steps to amend the Pension Rules as suggested above and help more than 50000 pensioners of LIC.

Pension credit on first of every month

No,enough precautions  are taken by LIC & RMOS SZ has instructed what date of a month AOPC or MGR OS DO shd feed Pensioners data to ensure that RBI instructions are followed in letter & spirit by all banks to help ensure all payments reach the recipients on 1st positively even
if it is a holiday or Sunday or Saturday holiday . 
Otherwise RBI wld not have come into the picture at all 
Requests were pouring in from
All Pensioner Fedns ,LIC saw its reality & necessity 
How else u say that barring 2 DOs SZ all did a good job, good PR with LIC banks & lo New Year pension gift landed 
I quoted 2 Bank examples also
SAD other Zones details of Successful pension credit on 1st is not known & I bemoaned silence to requests & emulate SZ empathetic process blessed by LIC CO
It is not payment before 1st or to coincide with date of Employee salary credit which LIC has refused thoroughly but agreed for positive 1st credit 
So just 1 working day before as warranted by the list of holidays data to be fed in will be carefully done as was done by those DOs in Dec end for a 1st Jan credit
Here too some banks of LIC were reckless not to appreciate serious implications for LIC Pensioners & such Banks wld have been identified by now 
I found not more than 2 such Holidays in SZ , May & August, for the 12 month Jan to Dec 2020 & earlier day in April & July are working days ,so no problem to advise Bankers & to caution them .Each RMOS & SDM / MGR  OS must have standard specific proforma Caution letter to their Bankers to act without fail & to faithfully implement RBI instruction to ensure pension credit from Bank SMS to all such Pensioners

Madam,
I refer to  your circular  Ref: Per/ER-A/Pension/Disbursement dated 08/01/2020 addressed to Zonal Managers.
Rule 54 of the Pension Rules state, 
"Manner of payment of pension -A pension fixed at a monthly rate shall be payable monthly on or after the first day of the following month."
You have mentioned in the last para of your circular that all pension disbursing units should ensure payment of pension invariably as per Rule 54 of LIC of India (Employees)Pension Rules,1995,i.e on the first working day  of the following month without any delay.While your intent in issuing these instructions is very well  appreciated,there is a basic flaw in Rule 54  of the Pension Rules.When it states "on or after the first day", it provides a lee-way for delayed payment of pension without any mandated accountability on the Corporation due to the open ended nature of the due date for pension stated in the Pension Rules.It is surprising that such a wording in the Rule has been allowed to remain for more than 24 years without amendment.
LIC being  an enlightened employer,I am sure you will appreciate,its obligations should be documented in the Rules appropriately.In that respect,the words,"or after" need to be deleted from Rule 54.Experience has shown that Pension Disbursing offices have been literally complying with Rule  54 by often making payment of pension after the first day of the following month causing immense hardships to LIC Pensioners.Even if the delay occurs due to certain problems arising in the bank network,the responsibility for payment of pension on the first day of the month lies with LIC as you will agree and LIC may need to attune systems suitably.
I hope the Corporation will take immediate steps to amend Rule 54 suitably and ensurer that the monthly  pension credit is provided in the bank accounts of pensioners  positively on the first day of the following month, especially when RBI has advised Banks to provide credit under NEFT transactions even  if the day happens to be a holiday.

My Salute to Shri R B Kishore sir

Dear Editor,
                First very happy new year 2020 & Happy Makar Sakranti to you as well as your all Valuable Readers & Contributors 
    Just now I read a post on your blog from Sh R B Kishore Sir & very purpose of my this post is to Salute him for extra ordinary hard work 24x7 being put by him despite advanced age and adverse health for welfare of LIC Pensioners Community 
  I retired on 31st May 2012 and happened to meet him for the first time during AIRIEF GC held at Ahmedabad in first week of November 2012 which was attended by me as a delegate from Panchkula Unit 
Sh KML Asthana was elected as President Northern Zone in this GC & Sh IP Puri as Secretary Northern Zone in said GC 
As per AIRIEF constitution each zone has to convene a Zonal Counsel Meet once in two years and Sh I P Puri as  Secretary & Sh Asthana as President issued a notice forAIRIEF    Northern Zonal counsel Meet proposed 

to be held at Chandigarh in March 2014 with Sh R B Kishore Sir as chief Guest 
Sh Kishore Sir had got his air tickets for Chennai to Chandigarh & back booked
Panchkula Unit  also invited Sh R B Kishore Sir to address our General Body Members which was accepted gracefully by him during his Chandigarh visit dates 
This annoyed Sh Asthana & as such he cancelled Proposed Chandigarh Meet without any valid reason at 11th hour and instructed Chandigarh Unit to boycott Sh R B Kishore Sir . We had already made arrangements for stay of Sh R B Kishore Sir for 3 days at LIC VIP Guest House situated in Sector 8 Chandigarh and none from Chandigarh AIRIEF Unit had even  basic courtesy to pay their regards  by meeting him at LIC Chandigarh LIC Guest House during his stay there 
Our Panchkula  General Body Lunch Meeting with address of Sh R B Kishore Sir  as our chief Guest  in March 2014  was a great success  & this visit also proved to be  an opportunity for me in person to spend adequate time in his sweet company 
As per my close view Sh R B Kishore Sir continues to work even harder with each passing year and as such he is respected by one & all and fellow indulging in dirty tricks has been reduced from Hero to Zero 
My humble prayers for his good health and favorable results of his continuous hard work with a positive Supreme Court Verdict before 31st  March2020  for Our  Pension Revision thereby annulling April 2017 DHC Judgement

LIC CO circular on pension disbursement on the first working day of the following month

Each day so much of important work emerges which keeps me tight 
I wanted to reply today but still my conscience told me that I shd speak to MD Sri Mukesh Kumar Gupta before  I reply .Ringing but not picking up & usual recorded tape I tried Sri TCSuseel Kumar, same ringing but not picking up 
So many Divisions got SMS credit from Bank on1st January 2020 itself Those Zones / DOs not a Holiday but working day for the New  Year , they also got credit 
CO Circular dt 8/1/2020 is retrograde & not in keeping with latest developments of forward-looking CO & contradicting in the Heading of the Circular & the last line of the Circular 
This may be the 1st Circular she signed perhaps & inducing Pensioners to be encircled in gloom
I feel that is not reqd & much of the good work is translated in all DOs except few who failed in PR fup with Bankers & so missed the Promised land of credit of Pension on 1st irrespective of Holiday, Sunday or Saturday Holiday 
I told RMOS & AO PC who diligently worked his way through & ensured credit on 1st Jan which was a Holiday for Tamilnad .Kerala & AP it was a working day & so no problem
   I may not be wrong if I say that out of  13 DOs & ZOPension, 5 are Kerala DOs working on that day & remaining 8plus ZO i.e. 9, barring DO 1 the biggest & Thanjavur, All other 7 appeared to have succeeded in ensuring Bright Sunny day for Pensioners after the So-called parting of Winterdays yesterday Bhogi festival ring out the old & ring in the New .That newness is visible in that fantastic RBI Notification whereby ALL ALL payments of whatever nature must be credited throNEFT 24/7& indeed it triumphed & so to say CO Top Mgt has not done OR only Horses Mouth shd be AFTER the event is over i.e. after the end result is announced is a Mockery of assertive & aggressive but legitimate & genuine demands of employees or pensioners, pursued with vigour & rigour , devotion & dedication by OB, EC members , Leaders & Activists who certainly have a duty to beam latest developments & result of dialogue or negotiations on pending issues & problems .Rome was not built in a day , so too problems get solved after a long delay & nobody shd be found wanting in relentless pursuit & resolve to see a lasting & fitting solution
 I also found when I went deep into the matter that ZO had connections with CUB i.e. City Union Bank & DO 1 with YES Bank which did not cooperate & now has been told & properly instructed ZO PC was a smooth operator. ( This I added somebody rang the bell & lo Chat had gone !)
I was also an active OB in Pune, Rajkot ,CHENNAI Fedn of LIC Class I Officers Assns & EC member too ,say near 20 years & in AIRIEF for near 22years after retirement .Looking back 42 years for a cause of Societal development in Look & outlook & with fair degree of success & dividends 
Age has not stunted mentally but physically I have become a wreck unfortunately due to excessive late hours Sitting much against Doctors advice to retire by 1030pm.

👉🏿 आज अचानक जापान ने इंडिया के साथ युद्धाभ्यास किया ।

Reg: Where our Matters are Headed ......

Very Happy  Makara  Sankranti, and Pongal to all of you. While the North of India is going through a very stiff winter, the South, of North of India, is enjoying comparatively equable weather, and these Festivals signify the change of season that is to follow.

The Banks have been in continued Meetings with the IBA and 13th of Jan 2020 was the last one. Unfortunately, there has been no further improvements in the offers from IBA. On the other hand they have made certain categorical statements, saying 5 day week and expansion of Encashment of Leave at Retirement cannot be given. They have also made it clear that the Financial up grades offered earlier cannot be improved upon.  The other significant aspects, of interest to Pensioners, is that no final word is there about Revision of Pensions, where the cost factor is still being examined. As for Family Pension, the matter is now with the Central Govt., and it is expected, that the improvement suggested, will be approved soon.

That puts paid to our expectations on the Banks Settlement regarding Revision of Pensions. Our hope was that if some finality could be reached there, it may pave the way eventually for its acceptance for LIC Pensioners too.  That would have lightened our expectations, in the on-going Case in the Supreme Court. But now we are back to square one, where the SLPs pending in the SC become important. As made out a number of times earlier, Supreme Court has only a small window open for us, where matters of violations of Rules, Law or Constitution alone would be examined.

We have been preparing ourselves assiduously on how we present our case in the SC when the matter comes up on the 5th of Feb. 2020,  in the SC.  There are two aspects that lie before the SC -- one relates to LIC's Compliance of DHC Order on Pre-1997 Retirees, where we have had to file a Counter Affidavit to say the implementation is grossly defective, and the other relates to the SLPs on Revision in Pensions. Our approach is now to see that the SLPs which should answer to most grievances of ours, including the inadequacies of implementation of DHC Order, if approved, should come first in the order of being dealt with. But we may not be in control of where the new Bench would like to start the proceedings.

Towards this end, we are preparing ourselves with points against the Arguments put forth in the Counter Affidavit of LIC to our SLP. If we are able to break ground in this attempt, then it might become easier for us to think of positive outcomes. Cost factor which was put up before the DHC, by the LIC,  should not pose a major hurdle here, as the DHC itself , while talking about viability of LIC being affected, if Revision in Pensions is given, concluded that , it was not on cost grounds, that it denied up-gradation . That leaves us with  the rest of the points like comparability to Central Govt. Retirees, Pension Rules not providing for Revision, Pension rules being uniform to all , and there being no Discrimination, etc. which the LIC's Counter Affidavit makes out in denial of Revision. Internally, we have been in consultations with all our erstwhile legal pundits, in firming up our points.

The silver lining this time around, is that we are freely conferring, and sharing views with the other Petitioners and that has given us the confidence that the push in the SC this time will be more focused and integrated.  Our plan is to have one final meeting of Petitioners there in Delhi on the 4th of Feb 2020, after which we will meet our Senior Counsel and have the exchange of points in a brief and pointed manner.

On the Organizational front, there is good news from Nashik, where as a result of initiatives taken by the leadership there, the Membership has gone up from around 40 to over 100! This is indeed a great leap forward, suggesting to others that efforts will bring results.  Kudos to them.
