 Recently a woman had Rs.8,16,000/- disappeared from her bank account.

  *How exactly did this happen?*
 
 1.  The mobile number which the woman had linked with her bank account.  She did not use that number for 4 years.

 2.  But did not inform the bank to delete it from her KYC.

 3.  Now, that unused mobile SIM number is closed by the mobile company and given to another person.

 4.  According to the mobile company policy, if any number is not used by you for 6 months, it can be given to someone else.

 5.  Now the regular incoming SMS of the bank started coming to the person who got the new number.  what did he do  So he accessed the bank's site through a link.  And wrote *forget password*.  Now the OTP of the link from the bank went to the number in his possession for authentication, he completed the formalities and happily withdrew all the money through internet banking.
  
 So, if you have linked your old number which you are not using or closed anywhere, what is it with your bank account, you have to go to the bank and delink that number as per banking rules.

 Please keep the above in mind.  Your unused mobile number for six months can be reallotted to someone else.

 This fact may be new information to many of us.
 It is very important.  Think carefully.

PARA 3A & 3B-AVOIDABLE HYPE

Removal of para 3A cannot be an issue.Para 3A deals with the rate of DR for employees retired from 1/8/1997 , the effective date of wage revision vide notification issued on 22/6/2000 ,which was fixed as 0.23%  by the Central Government. Para 3B authorized the Corporation to fix the rate of DR on  future wage revisions from 1/8/2002 onwards.The wage revision effective  on 1/8/2002 was notifified in 2005.With  the issue of that notification,Para 3A clearly came to be  related to the employees retired or dead between 1/8/1997  and 31/7/2002.The said Para is continuing to be in operation  for the retirees of the said period just as Para 3B is in operation for retirees of subsequent wage revision  periods from 1/8/2002(at 0.18%),1/8/2007(at 0.15%),1/8/2012(at 0.10%)  and 1/8/2017(0.08%).All these are according to the Pension Rules 1995 as they stand amended after all wage revisions thanks to Para 3A & Para 3B.So  where is the question of deleting Para 3 A?If Para 3 A is deleted ,what DR will be paid to Group 3 pensioners?If Para 3A is deleted,Para 3B will also have to be deleted and there will be an impasse in payment of pension without a valid rate of DR.Having merged DA on wage revision dates with basic pay,the DR on pension has to be definitely lower/different  than/from that for the previous period retirees.It is another matter if pension upgradation is provided with every wage revision( for which we are legally fighting) when there will be one rate of pension and one rate of DR for all pensioners.
It will be therefore futile to treat Para 3A as a villainous element in our Pension Rules,but rather use that para to  achieve our purpose.Para 3A equalised DA/DR for serving employees  and retirees from 1/8/1997 unlike in the earlier period.Para 3A was interpreted in a manner that facilitated revision of basic pension for pre- August 1997 retirees  from 1/8/1997 as per decision taken in the LIC Board Resolution dated 24/11/2001 which was also demonstrated in the payment of 40% interim relief following the SC judgment dated 31/3/2016. In fact the interpretation of Para  3A by LIC to prepare illustrative charts sent to GOI after the Board Resolution  and payment of 40% IR in 2016  as per SC judgment  prove that LIC has conceded that pension can be revised  on 1/8/1997 which is the foundation for upgradation of pension for all pensioners with evey wage revision.There are other strong grounds  as well to press our demand for upgradation of pension.
By going on a wrong track,we should not end up by losing a winning case(according to me notwithstanding any possible disagreements)in SC.
So  my  humble opinion is that we should not create a hype on Para 3A as one to be deleted from the Pension Rules or to be challenged for its constitutional validity.

This is with reference to the WhatsApp chat dt 11th inst from Shri Pramod Srivastava of GIC for which my comments are invited by your good self.

In the judgement dt 31-3-2016, the SC wanted to test the constitutional validity of these Paras 3A,B by referring the same to DHC. The DHC also in their judgement dt 27-4-2017 held that the same caused grave discrimination to similarly placed employees retired earlier to 1-8-1997.
Therefore these Paras are already on the purview of the Courts and cannot be taken away by the government without the permission of the Courts.  It is clear from the DHC judgement that the same should be extended to all the pensioners but the method of implementation suggested by them is being contested by us now in SC.
In my opinion these Paras are vital for our case now going on in SC and should be implemented in Letter and spirit for all the pensioners without discrimination and date of Retirement, which will ultimately be Upgradation of pension.  

In a recent judgement, the SC observed thus : 

,"Pension Rules Must Be Interpreted In Favour Of Employee When More Than One Interpretation Is Possible : Supreme Court"
In these circumstances, it is impossible to remove the above Paras by the Government.

In-charge-Financial Sector ,BMS and detailed about the pending issues with DFS and requested for immediate intervention to hasten the process of Notification of enhanced Family Pension and other issues.

# On 24.9.2022 a detailed letter was addressed to Finance Minister on Pension revision on OROP basis and other issues and implored upon her to give her accord for these pending issues.

# Our GS along with
Sri Ram Dhumane met  Sri Hiranmay Pandyaji, All India President, BMS
at Pune and handed over the letter addressed to FM regarding our pending issues and submitted a memorandum.

# On 1.10.2022 in the Virtual Meeting of BMS, opportunity was taken to draw the attention of Sri Surendranji, Organising Secretary, BMS about our long pending issues with DFS.
Sri Surendranji expressed highest regards & respect to our GS. He assured to follow up our issues.

# On 7.10.22  Sri Ashokji Joshi along with Sri S.M. Wate, Sri K D Deshpande and Sri Vivek Deshpande met Sri Ravindra Himateji, All India General Secretary, BMS at his residence in Nagpur and  discussed the whole gamut of issues for more than an hour.
He indicated that he will raise this topic in the BMS advisory committee meeting.

NOIP is in constant touch with BMS leadership to hasten the process of clearance/notification of pending issues from DFS.

Delay in notification of enhancement of Family Pension

One of my friends and batchmate informed me that one family pensioner of a deceased AO of LIC  at Chennai who died while in service in 2013  was receiving family pension and she also recently died  unfortunately on 1/9/2022 in a road accident.He informed me that she was frequently enquiring when she would get enhanced family pension when she was alive.Unfortunately, she did not live to enjoy increased family pension when it will be  notified.
For some reason or other ,the notification of increase in family pension is getting delayed despite the fact that Banks' family pensioners were more fortunate to get  the increase more than a year ago.But not only the family pensioners are anxiously waiting for the increase from their meagre pension, but also battling health issues and  the threat of mortality on account of delay in the notification.I have a hunch  that during the period of the last about three years since the LIC Board recommendation was sent to the DFS, some family pensioners might have unfortunately passed away without getting the benefit of increase.I feel that we should bring this fact of deaths of family pensioners to the  notice of DFS and FM, so that the gravity of the situation will be appreciated and expeditious decision will be taken at their end.
I would suggest  to  our pensioner friends to  furnish  information of deaths of family pensioners during the past one year  as known to them so that  we may write to Secretary(DFS) & FM in the matter for expediting the notification. 
It will help if the information is furnished within a week.

You are aware of our meeting with Hon'ble Union Finance Minister on 4th October 22.  *Today (11.10.2022) we had an opportunity to have a  meeting with the Senior Executives of IBA at the Office of IBA at Mumbai*.We convey our thanks to IBA  for the hurriedly called meeting where we had been given a patient hearing for more than three hours and the meeting concluded at 3.15 PM

We placed our views at length on the following issues which concern the interest of Retirees:

1.*Updation of Pension for all who are eligible upto 11th Bipartite Settlement*. 

2.100 per cent DA neutralization to pre November 2002 Retirees.

3.Mediclaim insurance cover for Retirees-- premium to be borne by Banks.

4.Special allowance to reckon for superannuation benefits viz. Pension and Gratuity. 

5.Option for pension for the resignees who completed  Pensionable service. 

6.Improvement in Ex-gratia for Pre-1986 Retirees / Surviving spouses.

7.Consultative status for Retirees' Organisations.

We believe that the meeting has been very meaningful and  purposeful.We assure the members that our relentless efforts will continue till we reach the desired goal.

Open Network for Digital Commerce (ONDC) is an initiative aiming at promoting open networks for all aspects of exchange of goods and services over digital or electronic networks. ONDC is to be based on open-sourced methodology, using open specifications and open network protocols independent of any specific platform.

 

The foundations of ONDC are to be open protocols for all aspects in the entire chain of activities in exchange of goods and services, similar to hypertext transfer protocol for information exchange over internet, simple mail transfer protocol for exchange of emails and unified payments interface for payments.

 

These open protocols would be used for establishing public digital infrastructure in the form of open registries and open network gateways to enable exchange of information between providers and consumers. Providers and consumers would be able to use any compatible application of their choice for exchange of information and carrying out transactions over ONDC.

 

Thus, ONDC goes beyond the current platform-centric digital commerce model where the buyer and seller have to use the same platform or application to be digitally visible and do a business transaction.

 

ONDC protocols would standardize operations like cataloguing, inventory management, order management and order fulfilment. Thus, small businesses would be able to use any ONDC compatible applications instead of being governed by specific platform centric policies. This will provide multiple options to small businesses to be discoverable over network and conduct business. It would also encourage easy adoption of digital means by those currently not on digital commerce networks. 

 

ONDC is expected to make e-Commerce more inclusive and accessible for consumers. Consumers can potentially discover any seller, product or service by using any compatible application or platform, thus increasing freedom of choice for consumers. It will enable the consumers to match demand with the nearest available supply. This would also give consumers the liberty to choose their preferred local businesses. Thus, ONDC would standardize operations, promote inclusion of local suppliers, drive efficiencies in logistics and lead to enhancement of value for consumers.

 

This information was given by the Minister of State in the Ministry of Commerce and Industry, Shri Som Parkash, in a written reply in the Lok Sabha today.
