S.O. 2103(E). — In exercise of the powers conferred by clause (v) of the Explanation to section 48 of the Income-tax Act, 1961 (43 of 1961), the Central Government hereby makes the following further amendments in the notification of the Government of India, Ministry of Finance (Department of Revenue), Central Board of Direct Taxes published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (ii) number S.O. 1790(E), dated the 5th June, 2017,
 namely: – 
In the said notification, in the Table, after serial number 23 and the entries relating thereto, the following serial number and entries shall be inserted, namely: –

Respected sir,

The Confederation of Central Government employees and Worker's, having more than 130 Central Government/PSUs employees Associations /Federations, as its affiliates, would like to bring to your notice the following facts, in support of the subject cited above.

That, the fixation of Commutation Factor (CF) is done as per Central Civil Services (Commutation of Pension) Rules, 1981 (Last Amended Date: 06/06/2013) , These rules are having lot of flaws in it, and requires revisit on the issue as in last decade lot of changes have occurred in interest rates , mortality rate life expectancy .The LIC table of 94-96 is being used with interest rate of 8% and is effective from 2/9/2008

The LIC table 94-96 is not a valid table after 1st April 2013, as LIC Ultimate table validity expired on 31.03.2013 as Indian Assured Lives Mortality (2006-08) Ult.- Published Mortality Table, became effective from1st April, 2013 after this new table should have been reconstructed. Bu still in the year 2024 after the retirement the Central Government adopts the same table of 94-96 for providing the Commutation Factor (CF) for its employees & pensioners.

Commutation table should be reconstructed every 5 years due to changes in RBI repo rate, market interest rates, life expectancy and mortality as is being done for the CGIES and GPF rates, which are being revised every Quarter of a year.

The Institute of Actuaries of India has been reconstructing the mortality tables every eight years ie 2005, 2013 & 2021 but the commutation table has not been reconstructed after 2008, need of the hour is to reconstruct it with retrospective effective dates of 1st April 2013 and 1st April 2021.

The policy of the Central Government towards its employees who have rendered their Services for the Nation building for more than 30 years, should be sympathetic towards its employees and they should look after the welfare of employees and particularly pensioners as a model employer, the concept of profit making for central government on these sensitive issue should not be the criteria for fixing the commutation factor and restoration of commuted value of pension.

The methodology used in computing the Commutation Factor (CF) is also not correct. The important issue is recovery period of 15 years is improper as the recovery takes place less than 11 years it should have been 11 years instead of 15 years recovery period as interest is recovered in 2.66 years.

SECOND NATIONAL JUDICIAL PAY COMMISSION (Part III) appointed by Hon'ble Supreme Court of India copy enclosed, has examined in detail on the subject of commutation of pension from page 88 to 112 of its report.

Hence deep study on this subject is required by the Central Government to protect the interest of its employees and pensioners who have served Nation for more than 30 years.These expert bodies have erred in proper fixation of commutation factor which has resulted in loss of 16.5% less commutation amount received by Employees.

  • 1)
    Those employer who have retired on 1/1/2005, for them Commutation tables one table -1 is effective from 1.3.1971, – till 1/1/2006 with an interest rate of 4.75 %. Age 60 years, next birthday falls on 61 years, Commutation Factor (CF) is 9.81
  • 2)
    Those who have retired on 1/1/2008, second commutation table-2 which is effective from 2/9/2008 till now with an interest rate of 8 %. Age 60 years, next birthday falls on 61 years, Commutation Factor (CF) is 8.194

The lowering of commutation factor from 9.81 to 8.194 from the age of 61 years as next birthday has resulted in reduction of commuted amount to the extent of 16.5%.

The commutation table is being prepared on the grounds of four parameters, as per the commutation table prepared in the year 1994 prepared by the LIC of India that is 1) Interest rates 2) Life expectancy 3) Mortality rate 4) Period of recovery.

The fixation of Commutation Factor (CF) is based upon the Table, based on LIC (94-96) Ultimate Tables and based upon rate of interest of 8% and the mortality factor is published by the Institute of Actuaries of India (IAI) in the year 2005.

The mortality rate has been reducing year by year and life expectancy has been increasing year after year. The interest rates vary from year to year.

The important issues are that a recovery period of 15 years is improper as the recovery takes place less than 11 years. It should have been 11 years instead of 15 years recovery period as interest is recovered in 2.66 years.

The interest rate for fixation of Commutation Factor (CF) is 8 % is very high as compared to GPF rates of 7.1 % after 2020 and other government rates on deposits, instead of that actually RBI repo rate should have been adopted. The RBI repo rate was at 6.5% as of Dec 2008 and started declining from 2019 onwards to 4% and once again in 2023 it is 6.5 %. Between 2019 to 2023 we had very low interest rates, but central government charged 8% for its pensioners instead of 6%. especially after the year 2020.

The mortality factor is published by the Institute of Actuaries of India which shows risk factor of just 1% and life expectancy is 80 years as per Census department source: www.censusindia.gov.in/SRSpublications

In View of the above facts and considerations, the Confederation of Central Government Employees and Worker's, requests to kindly consider sympathetically and arrange the Re-fixation of the commutation factor and tables with retrospective effect from 1/4/2013, and thereafter every five years, and render justice to the Pensioners.

We have to invite your kind attention towards the Circular Ref: CO/Per/ER-A/340/2024 dated 7th May 2024 issued by the Central Office on the aforesaid subject and our letter dated 15/05/2024 whereby some anomalies regarding payment of ex-gratia, inter alia, were pointed out for favour of your kind consideration and rectifying the same. The affected pensioners are clueless about the payment as the Divisional Offices are not able to clarify their queries. We therefore request you to kindly issue suitable instructions to the offices concerned on the following points:

  • 1.
    Payment of ex-gratia to the pensioners who retired from the post of Superintendent,
  • 2.
    Payment of ex-gratia to the officers who were placed in the higher scale at the time of their promotion but continued to be in their present designation, on the basis of the cadre in whose pay scale they were placed. Conventionally all the monetary benefits and retirement benefits are paid to such employees on the basis of pay allowed in the higher scale of pay.
  • 3.
    Payment of ex-gratia to the Family Pensioners on the basis of notional age of the deceased employee/pensioner as on 7th May 2024 and not on the basis of the age of the Family Pensioners. As per the spirit of the pension rules in respect of Family Pension and the tradition of the Corporation, the retirement benefits are paid on the basis of the age/notional age of the deceased employee/pensioners and hence the request.

We are sanguinely looking forward for favourable consideration of our request and issuance of necessary instructions to the offices concerned.

This communication of mine will relate to several subjects relating to the  fraternity. The recent happenings have not been too good to say for all of us particularly on the legal front. There however has been  little moment of joy for seniors and super seniors which will find a mention here.

 

1. Our Legal Case: After admission of our petition in February this year and converting the same to a Civil appeal, the bench fixed the date 24th April 2024  when not many cases will be before them for hearing with provision of a spare day for all petitioners to submit their pleas. With the Hon'ble bench giving the date, our hopes loomed large and we impatiently awaited the case to be taken up on 24th April. Incidentally on this day, s Constitutional bench was constituted for a matter deserving priority hearing. The day ended and our case did not come before the alternate bench and remained on board for hearing on 2nd May. On this day, cases upto Sl no 105 were taken up while our case was serial no. at 111. The case  remained on board for hearing but case serial 102 and 103 were cluster cases and for some technical reason, were not taken on 2nd May, were to be taken on 8th May and likely to consume time when it would be taken up by the bench.  Earlier, Adv Mr RK Singh informed on 3rd May that no cause list for 8th May would be circulated while our case would be on board. Later Mr RK Singh based on his enquiry from the Registrar informed Shri SS Saxena that due to frequent changes in the bench and not many working days left, the case would come for hearing after vacation in July 2024. We have of late seen the Hon'ble Court at work and have to believe we've become victim of the judicial system but nevertheless, we will continue to fight until justice is clinched. 

2. Exgratia payment : With the recent wage revision to in service employees, a proposal was sent to the DFS for payment of EG amount to pensioners, the number of which initially was circulated to be 30000. This created confusion and room for number of queries who were the ones not falling in this. However when the notification of wage revision was released, the DFS

approved payment of EG to pensioners aged 70 yrs and above as on 7.5.2024 causing

frustration to those pensioners aged between 60 and 70 yrs of age. The EG was not

demanded by us but we welcome the gesture of Corporation. We being Joint Front partner with 2 other Association and Shri MP Agnihotri ji being it's Convenor, we have submitted a memorandum to Chairperson with copy to MD and ED(P) demanding EG to those pensioners also aged < 70 yrs. His attention has also been drawn towards our discussions and demands on various Pensioner's matters submitted to Shri Satpal Bhanoo, Managing Director on 9th Feb. 2024. 

 3. Levy on Ex Gratia payment : On this, the matter was placed before the AIRIEF's OBs social media group where mixed opinions were received for the reason that senior and super seniors donot receive pension enough to sustain a respectful living and it will not be justified to demand levy from the lump sum amount they are going to receive. However, it is left to the respective RIEAs to decide and AIRIEF isolates itself from such demand

 4. XIIth Gen.Council Meeting at Asansol :The EC meeting held     at Bhopal in December 2023 had unanimously    resolved the GC meet to be hosted by RIEA, Asansol at Asansol from 9th to 12th Nov. 2024 (9th and 12th being arrival and departure dates respectively) notice of which will be given in due course of time to facilitate Delegates/Observers to plan their journey. The units are requested to extend all cooperation to the hosts in soliciting donation through coupons and advertisements for souvenir proposed to be released. 

 5. Zonal Council Meeting : All Zonal units are advised to hold their meeting by 15th September 2024. The Units may hold their GB meet before the Zonal Council meet. The Zonal Council may hold physical or Zoom meet, is left to them to decide. The ZC are requested to submit an estimate of expenses and obtain sanction of the amount, if physical meeting is resolved to be held.

 6. PST list: Our Working President Shri G. Krishnaswami has updated the PST list upto 9.3.2024. This list is also available with Shri Ashok Srivastava, Convenor (IT/Statistics).The affiliated units are requested to communicate name of Office Bearers (PST only) to him directly if there is a change post elections on his mail id *ashokk.srivastava0@gmail.com* (0 is numeric) which would facilitate him to update.

 7. Affiliation fee: As on date, 30 units have deposited the AF. Units are advised to deposit/transfer the fee in question before 30th June 2024.

 8. Varishtha Vaani : The house magazine's readership is increasing day by day concurrent with printing cost shooting high. The Chief Editor, VV has time and again been giving a call to the units to donate Rs.1000/- towards sponsoring a page. This year so far, Rs. 22000/- has been received. This gesture will certainly reduce financial strain on AIRIEF's exchequer.

 9. Other: a) Our Treasurer has more than once posted a list of open entries but remitting unit is not communicated as a result of which it is not appropriated. Pl follow the social media groups where such entries are posted. 

 b) Recently, I've received a communication from AIIPA Pensioners Assn. Gen Secretary Shri M. Kunhikrishnan, Calicut expressing need for building a joint forum on common Pensioners' matter. I am yet to reply and confirm to him of our willingness or otherwise but not without making things clear stat of level play status without any feeling of being different as all classes of retirees are same once they retire.

 

The nation is now into the last 3 phases of election and I am sure all of us have done the democratic duty of exercising franchise. By the time it is time for another communication is sent, the new govt. will be in place.
