SC Judgment on CIVIL APPEAL NO. 11527 OF 2014-No recovery of excess paid

Dear All,

I attach a recent SC judgment of Dec 2014 in the above case where the Supreme Court has ordered that the State Government cannot recover the excess amount paid to the employees by mistake. Ironically Supreme Court has been so kind to the employees who have received more money than they ought to have -of course for no fault of theirs-while the hapless old LIC pensioners have to patiently struggle for more than 17 years to establish their right to receive moneys legitimately due to them according to the fundamental rights enshrined in the Constitution.
I don't know whether our counsel in the SC can make use of this judgment to our advantage.
