BANK RETIREES NEWS: Registration of Pension Fund Trusts of the Public Sector Banks

UNION BANK RETIRED EMPLOYEES' ASSOCIATION

Date:
13th June,'15
Shri S.C.Jain,
General Secretary,
All India Bank Retirees' Federation,
Indore (MP).
Sir,
Registration of Pension Fund Trusts of Public Sector Banks

    1) As advised by you, our Association had undertaken an extensive exercise to extract information of  the Pension Corpus of Union Bank of India. As apprised to you earlier, the Bank is reluctant to provide us proper information. Our various applications under RTI for this purpose are escalated to the level of the Second Appeals to the Central Information Commission, which are pending for hearing. Our Association has

also entered into some correspondence with the Bank's management. We are moving according to expert advice of one Shri J.P.Shah, a RTI & Consumer Acitvist Member of our Association.

    2) In reply to such a RTI Application, the Charity Commissioner, Mumbai informed us vide its letter dated 22nd April,'15 that our Bank's Pension Fund Trust is not registered with them. A copy of their reply is sent herewith (Attachment No.20 to this mail).

    3) We also forward herewith soft copy of the last Letter dated 15th May,'15 received by us from the Bank. (Attachment No.22 to this mail). It states that the Bank has taken all the steps advised by the Indian Banks' Association in December, 1995 for formation of the Pension Fund. But the letter is silent about registration of the Trust. It implies that our Bank's Pension Fund Trust is not registered.

    4) When the above referred letter of the Bank was sent to Shri J.P.Shah for his expert views, he opined as per copy of his e-mail attached to this mail (Attachment No. 22(A)). We shall have to concur with the views of Shri Shah that if the Indian Bank's Association has advised the member Banks to form Pension Fund Trusts, it goes without saying that all the legal formalities related thereto (including registration of the Trust) must be done. If the trust is not registered, it is a VERY SERIOUS infirmity.

    5) My request to you is to inquire with the Retirees' Organizations of other Public Sector Banks (affiliated to AIBRF) whether their Banks have registered their Pension Fund Trusts. Whatever information you gather about other Banks may kindly be provided to us.

    6) So far as registration of our Bank's Pension Fund Trust is concerned, I am endorsing copy of this e-mail to Shri Pratap Shukla, General Secretary, All India Union Bank Retirees' Federation to pursue the matter further with our Bank as deemed proper by him.

    Regards.

Yours sincerely,
B.G.Raithatha,
General Secretary
