Teletalk with Chief(Legal)

Dear Shri Kishore,
Thank you for your elaboration. No doubt the finality can be expected only after 23/9/2015 when the SC hearing resumes.But how long the LIC can defy the judiciary is the question. The pension upgradation issue is so strong in our favour that if LIC fails to implement the interim order in the Supreme  Court in the right way ,the three sets of petitioners can concertedly launch contempt proceedings if only they want to  against LIC to force it to  obey the judiciary. But  such a proposition  seems to be wishful thinking in the present circumstances. The OROP outlay is not comparable to that for LIC pensioners, but what needs to be recognised is that the outlay required is only for compensating for the amount denied to he pensioners. The SC can easily be convinced on that point. So we have to wait patiently for 23/9/2015.But aggressive management of the cases is the need of the hour including engagement of a  high profile senior counsel who will be duly taken note of by the Supreme Court.

3)We all see the happenings on OROP front,when all thought all is over satisfactorily.Pity is even after announcement Govt has set apart Rs8300cr,yet NAMO govt could not take decisive final step & we witness tomorrows protest

4)Here too in our case, LIC is cocksure any talk of pension revision can come ONLY after Final hearing on & after 23 September 2015.At present, other niceties, noone in LIC or UOI are bothered

A few questions on Tele Talk with Chief (legal),CO
Referring to the useful report of Mr R B Kishore coming at a time of apparent information vacuum, I feel some enlightenment is required on the following points:
  • Chief (Legal) has informed that 20% out of the amount deposited earlier in Rajasthan HC will be paid to them.
Will the amount be paid only to the Jaipur petitioners or will the proposal be extended to Chandigarh petitioners  also?
  • Where do the Delhi HC petitioners stand where no payment has been deposited by LIC  in the HC Registry and where  significantly in rem benefits have been ordered by the HC  to be paid by LIC?
  • As regards the SLPs by UOI, the SC have ordered,"S.L.P.(C) No.....CC Nos.5437-5440/2015 Issue notice on the applications for condonation of delay, as also on the special leave petitions" So even though there is a near certainty that leave may be granted, Chief(Legal) was technically not  correct in  stating that SLP has been admitted. Whether leave is granted will be known only on 23/9/2015.So awaiting final outcome is irrelevant  to compliance with the interim order of SC.
Unless clarifications are available on the above points, we cannot be clear about the thinking of the legal dept  on LIC's  compliance with the SC's interim order dt 7/5/2015.
