Sri ASR does not indulge in emotions or polemics.His is profound
legal,constitutional & other valid points & arguments to press our
demands, to rebut LIC, UOI submissions.
2}Very important point is , & there may be truth in it, Sr
Counsels , do not, at all times,remember or understand & appreciate many
finer arguments, valid & piercing data & umpteen such I had provided
,not only in My Supplementary to Sri KMLA, but also reams of pages for Legal
Committee Meeting, Bhopal,working day & night,with intense rigour &
vigour ,as I was not fit for travel
3)From many angles, ASR has dwelt with assertive & powerful
submissions to repulse UOI, LIC belated submissions, knowing full well,
they have been driven to a corner.
4)KMLA's Reply or Counter Affidavit is class.What finally he is
submitting will be relevant & I hope he has taken into account many many
from my dissertations & other powerful points from activists,in particular,
to consolidate with assertive reason,logic,suave arguments,LICs sound position
as a Rock of Gibralter,substantive presentations with point by point rebuttal
of UOI stand. LIC is always portrayed as an insuperable institution
of financial solvency and stability
5)Indeed, the
argument to seek preponement of sitting, as majority pensioners are 70,75,80
yrs & more, must come as an important & forceful plea to SC Bench to
realise the gravity of procrastination by LIC, UOI to deny equity &
justice to pensioners, as also violation of Human Rights to Elders & Sr
Citizens.pretty old, infirm, with
multiple old age problems & diseases & many lying on their death
bed.
More so when the case has
attracted delay & dither and running a meandering course
of 17 years witnessing the stark tragedy of deaths of more than 15,000
pensioners
6) SC must prove & demonstrate that law & justice alone can act as
faith and powerfully repulse the agony and inequity being perpetrated
against this aged vulnerable sections of society through acts of discrimination
& granting Twin benefits from the date of anomaly & discrimination. LIC is bound to honour
and implement in letter and spirit without continuing its intransigence; Hon
Apex Court must also reprimand UOI & LIC for such an inordinate delay &
treating the aged pensioners,who have made LIC a unique & sparkling
financial institution of great reputation, with utter contempt & disdain.
7)I have gone thro every single line of ASR, highlighted in
different colours to stress importance. LIC Board resolution as a foundation for
equal DR & pension revision with fitment weightage, same as for employees
wage charter, subsequent SECRET letters dt 31/12/2001 from LIC CO to Addl Sy
,MOF suggesting dire need for inter-generational parity in pension with
suitable CPIndex,series of positive victories ,needs no recapitulation as many
of us are fully aware,8/8/2013 SLP 29956/57 dismissed by SC Bench,
30/9/2013,with all mighty efforts by LIC Sr Counsel, SC Bench stuck to its
position & declared NO STAY ORDER on Hon Jaipur Order & allied
matters. SC cannot be a mute spectator to perplexing anomalies & monstrous
pension differences whereby a Substaff gets more pension than his 8/9 cadre
Senior ZM/ED. Above all,violation of Fundamental Rights enshrined in
Constitution ,Basic pension remaining, same abysmal for 22 years, is a
perversity which has to be reversed & remedied immediately. Above everything
else, the 1st July 2015 judgement by Hon Dipak Misra & Hon Sapre should be
driven home with power & potency, as Nakara judgement of 5 Judge bench of
Hon YVChandrachud is delineated by these 2 Hon Judges with precision & our
Sr Counsel must grab fullest attention portraying same & pleading with Hon
SC Bench Dipak Misra & Praful Patel. Let us pray that Fedn of Retd
Class I Officers Assns response to LIC CO letter to comply with the list by end
of July 2015 does not upset the applecart ,while complying with SC Bench 7th
May 2015 Order
