WP(P) 4894/2016

Dear Sirs,
The first two Applications are important (but routine) Court formalities.
We are supposed to file along with the Writ Petition, a number of 'certified' Copies which include Court Orders and Judgements also. But it is time consuming.
The first Application is to seek exemption from filing the certified copies and accept photo copies.
The Second is also similar where we seek permission to file photo copies of a number of bulky documents as Annexures (instead of filing neatly typed copies of each of the Annexure). Legibility of any document filed is essential. We file photo copies if they are clearly readable. Otherwise we get all of them typed.  We did it for scores of pages.
The Applications seeking permission is done through Sworn Affidavits. Those two Applications were allowed. The procedure is a little more strict in Delhi HC.
The third Application was for interim relief in which we mentioned about SC Order to pay 40% etc., and submitted that LIC has not fully complied with the same. (as on that day). There was brief discussion before the Bench on our submission. Justice Khanna is very well aware of the SC Order on that and observed that he does not wish to go in to that aspect.
Our Sr Counsel took to the notice of the Bench that LIC is supposed to pay and file an Affidavit after making 40% payment. Justice Khanna's remark was "we don't know, they might have filed it before the Supreme Court''.
Our Counsel clarified that the Affidavit was ordered to be filed before this Hon'ble Court (Delhi). ''Ok, in that case make your plea about IR (compliance/non-compliance) afresh after the Affidavit is filed. We will examine''. Accordingly, we were allowed to withdraw the Application now and file it afresh.
While permitting us to withdraw the CMA, the  Judge recorded our concern (on proper compliance of IR payment order). Our purpose is fully served. We now have options open, on how to approach SC/HC on LIC's colossal bungling on 40% IR payment.

A detailed Note from the Hyderabad Association, is in the making on the IR issue.

Hope this clarifies and thanks for the query. Sorry, if the narration is too long.
