come in our way with regard to the capacity of LIC to pay as they have already
taken the said plea in their counter affidavit dated 01.08.2016.

Our legal counsel will have to
counter it suitably in the Delhi HC.Considerations of policyholders' interest
equally well applies in case of wage increases in successive wage revisions.LIC
does not undertake cost-benefit analysis before wage revisions are effected or
liberal perks are given.But pensioners are denied the just benefits due to them
for over 20 years.
There cannot be different treatment
for recipients of salary and pensioners on cost considerations.

In my view, this judgement can be
cited to our advantage also. When a legal liability to pay is upheld by the
Court, inability or unwillingness to pay citing financial implications, is not
acceptable. It applies more to Pension liability.
