Court matters that stand today ( My personal version )



Dear Colleagues,
Grand Cheers to one and all !

Shall we spend sometime enjoying the gimmicks of the concerned bureaucracies played against our legitimate demands of 100 per cent DR neutralization and periodical upward revision of pension ? They believe that lies, if told umpteen number of times repeatedly, would convince people to admit that they are true. With the same doctrine, LIC Management and GOI have stepped into Delhi High Court with bundles of lies to divert the attention of the judiciary with the sole aim of getting our writs dismissed. Alas ! We have to pity their unscrupulous, rewardless, unjust, illogical and unsung attempts They know fully well that all those lies would not last long. You cannot cheat all, all the time.
Some of their untenable arguments : -

1. Nothing is said about upward revision of pension in the basic Memorandum of Understanding,
2. LIC pension is based on Banks pension,
3. If upward revision of pension is agreed, it will create ripples in the nation's financial order,
4. LIC is answerable to policy-holders,
5. Out of the surplus fund 95% is declared as bonus to policy holders and the remaining 5% as share to GOI,
6. Outgo of present system of pension is on the increase every year,
7. Further increase in pension would affect bonus part of policy-holders,
8. LIC faces stiff competition in the market,
9. Inflow of premium has started diminishing,
10. LIC is struggling hard to keep the overall cost within statutory limit,
11. Central Civil Services Pension Scheme does not apply to LIC Pension Scheme
12. The judgment of Nakara case does not relate to LIC pensioners,
13. GOI has got unquestionable powers to restructure the salaries and service conditions of the employees,
14. LIC can act only upon obtaining prior approval from GOI
15. Some such imaginary obstacles,Etc, Etc.

Let us all be rest assured that our All India Retired Insurance Employees' Federation is fully prepared to counter these unfounded and baseless arguments with forceful and law-based facts and figures. As you all know, we have engaged a reputed Sr.Counsel Sri. Nidesh Gupta who is well versed in law, elocution and presentation. We must thank our office-bearers and the members of legal-committee who have sacrificed their time, energy and comforts in collecting the required data from various sources and submitting the same to our Sr.Counsel through Sri. R.K.Singh, another veteran counsel, for preparing our replies to the rejoinders of LIC & UOI.
First hearing at Delhi HC commences from 27th of this month. LIC & UOI have raised bogus arguments to deny our rightful demands, engaging prominent counsels at huge cost. They do not mind spending public money to satisfy their whims and fancies. But they are sure that their arguments are based on imaginary base and hence the final order would emerge in favour of employees.
So friends, the chances of winning in the current legal battle are bright and assuring. Our Federation will take care of us in all respects. Our first & foremost duty is TO SHARE THE HEAVY COST involved in it. Final word will come from Delhi HC before 31st January, 2017. We might wait for another one or two months to secure the nod of Supreme Court. You could understand the NECESSITY OF FUNDS required at this crucial juncture.
Let us demonstrate our liberality in contribution towards legal fund and
our involvement in the activities of our trusted Federation.
