MC Jain Case - Am I eligible to be included?
Dear Mr Mahadevan, I have been pestering you by asking you frequently whether pensioners like me who were Class I Officers between 1/8/1992 and 31/3/1993 are eligible to be considered beneficiaries under the M.C.Jain case judgment. Your trailing mail makes the position quite clear and convinces me that the game is not worth the candle. Regards. P. The M C Jain case judgment can benefit only those Class I Officers who retired between 1/8/1992 and 31/3/1993. But by extended implication, Class I Officers who retired after 1/4/1993 can legally claim that they should also be paid the benefits of wage revision effective from 1/8/1992 to avoid discrimination vis-s-vis MC Jain category of retired officers.But this category of officers will have to file a separate Writ Petition in High Court/s against LIC for payment of the difference in salary from 1/8/1992 to 31/3/1993.This category even includes in-service officers including the present Chairman of LIC. The benefits at the maximum may be about Rs 5688 for AAO and Rs 24400 for ED at the maximum of scale. Kind regards. C H Mahadevan
