e Circular dated 14th Feb 2017

Today’s proceedings in DHC

Arguments in our cases commenced today in the afternoon, at about 2.45 PM. We would like to convey that it was indeed consoling that this will be indeed the last lap of hearing.

The Court had earlier expressed that certain matters of actuarial calculations be explained. LIC had arranged to bring ED (Actuarial) to be present for today’s hearing. She answered a few queries from the Bench.

Shri Nidesh Gupta Senior Counsel for other petitioners argued for close to 1 1?2 hours, and stressed that DS Nakara Case well applies our issues as well.  He cited several case laws to strengthen his argument. As it was closing time, he could continue tomorrow. His focus among others was that pensioners are in a homogenous class and cited sufficient case laws in support of the same.

The matter will therefore be resumed at 2.15 tomorrow. We expect our Senior Counsel to put forth his points. We shall communicate again tomorrow.
