LEGAL LIABILITY

About  a year ago I read in The Hindu about a Supreme Court judgement in an appeal by Kerala Road Transport Corporation (KRTC)
KRTC bus hit a temple elephant causing its death. Temple authorities claimed compensation on the ground that elephant was fetching considerable money to the temple as it is being hired by other temples.
First, KSRTC argued that compensation cannot be for animals, When it was turned down by the court they argued that as the Corporation was running on losses, it cannot afford compensation. To this Supreme Court humorously remarked; So you are a white elephant and hit a black elephant:
Ultimately court ordered payment of compensation as KSRTC  was legally liable.
From this it is clear, where there is a legal liability, financial incapacity is no excuse at all.
vvln sastry.
