LIC directed to File Rejoinder to Hyderabad's Written Submissions

M SREENIVASA MURTY MARCH 24, 2017
FROM THE HYDERABAD ASOCIATION WHILE WE WAIT FOR THE VERDICT……..Part 5

Dear LIC Pensioners and Family Pensioners,

Following the Flash news I had posted this morning, I am flooded with phone calls throughout the day. Apart from conveying to the callers what I was told by our Lead Counsel Shri Saurav Agrawal, (I do not propose to make it part of this Report) I answered their other queries also.
Some common questions and my replies (based strictly on the clarifications I got from our Advocate) are given below:
After the arguments concluded and the Judgement reserved, is it normal that one party is called and directed to file a Rejoinder to one of the Petitioner’s Written Submissions?
It is NOT NORMAL, BUT RARE. While the Judgement is being dictated, over several days and weekends, it is not unusual, though rare, for the Judge to call a Counsel to his Chamber and ask for any clarification.
1.Is LIC asked to do likewise in any other Petitioner’s W/S?
As far as we know, No.

2.Will this development cause delay in delivering the Judgement?
Not necessarily. We have reasons to hope that the Judgement may come by 31st March.

3.When it is normal to ask Parties to file Rejoinders, what makes this an extraordinary and welcome development?
W/S were filed by all the Petitioners and LIC. Evidently Court picked up and decided to give an opportunity to LIC to rebut the contents of our W/S. Theoretically it can prove our facts and figures wrong. If it fails to do so, our contentions and claims remain. Whether it is Extraordinary or ordinary, it is certainly a welcome development, viewed from several angles.

4.What is the time given to LIC to comply?
Not known, but it cannot be more than two/three days. It could be by Monday the 27th March. LIC and its Counsel may have to work during the weekend.

5.How should one look at this development?
WELCOME IT, AS WE ARE DOING

I attach a copy of the First page of our W/S which gives an idea of its contents.
GOD BLESS LIC PENSIONERS
