FROM HYDERABAD RETIRED CLASS I ASSOCIATION- OUR CHALLENGES AHEAD

DEAR ALL,
We from Hyderabad Association are still trying to cope with the severe vacuum created by the demise on 8th July 2017 of our beloved M Sreenivasa Murty who was the leading and guiding force of the legal crusade of LIC Pensioners taking upon himself the onerous responsibility and burden with utmost commitment even virtually sacrificing his life for the cause of pensioners.
While it is reported that AIRIEF have since filed their SLP and Class I Retirees' Federation are also ready to file it, we could not stick to the deadline of 90 days due to the impasse created by MSM's demise and some resultant legal issues. We are still in the process of finalization of our SLP which will be filed with a prayer for condonation of delay. Considering our circumstances, we are sure that the slight delay will be condoned by LIC.
Our Treasurer Mr Y V Subba Rao and Mr M V Ramana, EC member visited Delhi on 27th inst and returned after some useful discussions with our counsel on our filing of SLP and further conduct of the case at SC.
Now we are in a situation where we have to continue the legal struggle launched by late MSM in the SC in the face of inadequate monetary resources. We had, of course, built up a strong case in our WP No 4894 0f 2016 at DHC, but in the common judgment of the Court, only a section of pensioners could only get partial relief as our main prayer for upgradation of pension was rejected. Now we have a Himalayan task before us to pursue the case in SC through our SLP.
With grossly inadequate funds at our disposal, we have no other alternative but to fall back upon the valuable contributions of not only members of Association, but also pensioner colleagues across the length and breadth of the country to fight this strong but expensive case. We had received widespread support from pensioners across the country for our meeting the cost of the case at DHC cutting across affiliations to various Associations. Unfortunately we did not meet with success at DHC.
We are now sure that we will continue to receive the same support-or even of a higher degree- considering the higher cost of litigation to be met at SC to carry on the fight to its logical –hopefully successful-conclusion. Every pensioner is justified in making his/her major contribution to his/her own Association, but considering that all Associations fighting the case have one single purpose viz, removal of pension anomalies and upgradation of pension with every wage revision.
No doubt all the pensioners desired to have a unified legal fight, but for practical reasons of the distinctive functioning of the various Associations, such a unity of action did not materialize. But I feel there is unity in diversity. None can deny that each petitioner in this case, besides striving for success also wants other petitioners to succeed for the simple reason that all pensioners can reap a common benefit from a favourable judgment at SC.
In such a background, I once again appeal to all my pensioner colleagues to contribute liberally to our legal fund to enable our Association to continue and sustain the legal fight to obtain justice for aged and ageing pensioners.
My humble request from each pensioner is for a minimum contribution of Rs 5000 if he/she can afford the same. Those who feel they can contribute more are welcome to do so. No doubt it will involve some sacrifice on the part of pensioners in the present dispensation of unrevised pension, but I am sure all will appreciate that it will be an investment worth making. Nothing can be more disastrous than a strong case suffering for want of money to conduct the litigation as the stakes are very high.
I have no doubt that all pensioners will appreciate & cooperate.
