Our case in SC today

Dear All,

As we are aware, UOI's advocate and LIC's advocate submitted letter in circulation requesting for adjournment of the case, when they learnt that Shri R K Singh has made a mention before the bench and cases are coming up for hearing on 16/4/2018. In the past also this has been happening. In the first hearing held in Aug 2017, SC gave 6 weeks' time to LIC and UOI for submitting the Counter; but LIC intentionally delayed their counter and UOI even did not bother to submit it till date and suddenly sought for more time to submit their counter. It appears to be an intentional move to harass the petitioners who are aged and ailing persons and cannot afford visiting the SC and paying high fee to the advocates frequently.

But, as our veteran leader and VP Shri R B Kishore said, we cannot be a helpless on looker all the time, so we decided to ensure appearance of our Sr Advocate Shri KTS Tulsi in the SC on 16/4/2018 to counter the ill-intended move of LIC & UOI and clear the way for further proceedings.

As informed by Shri D D Gupta and Shri B S Verma, who were present in the Court today, Respondents advocate's request for adjournment was vehemently objected by our Sr Advocate Shri KTS Tulsi. Shri Tulsi insisted for grant of leave as well as payment of IR to pre-Aug 1997 pensioners as well as to post 1997 pensioners. LIC's advocate submitted that DHC has rejected the claim of revision of pension so any relief cannot be granted. Countering LIC's advocates arguments, Shri Tulsi gave reference of SC order and submitted the statistics of pensioners pleading that most of them are septuagenarian and leaving word day by day so immediate interim relief must be given to them. The Judges took the notes form Shri Tulsi and discussed the matter among themselves for a while and then ordered to decide the matter on merits in next hearing to be listed on a non-miscellaneous day in second week of July 2018. Shri Tulsi then prayed for an early date preferably on any Tuesday in May 2018. The judges, referring to diaries, showed inability to give earlier date and assured that on next hearing entire matter will be decided on priority and on merits.         

Here, I may inform that as per SC Rules miscellaneous days are those on which new cases are taken up and long arguments are not made. Non-miscellaneous day is generally Tuesday when old cases are heard and long arguments are allowed.

As informed by Shri B S Verma, today only Shri KTS Tulsi spoke on behalf of the petotioners.

Representatives of some of the other petitioners were also present in the court.
