Subject: Re: A Writeup for Final Sharp Penetrating Submissions to SC Bench by Sr Counsel

Respected Sir,
Thank you for the information.

I would like to stress that the Basic pension will not be static but has to be enhanced as  and when the SCALE of pay is revised. In this regard  the Rule 36 (d) may be referred  to which says in case of any wage Revisions in future,  the amount of Minimum Pension payable to an employee shall be determined by the Corporation corresponding to the Index to which the SCALE is linked. Certainly the Minimum Pension of each cadre  would get enhanced whenever the pay Revisions take place , consequently  and logically the Basic pension of all the caders  also .

If we compare the Minimum Pension in respect of the wage revisions in ,1987, 1992, 1997, 2002, ,2007 and 2012.we will notice substantial increase in the Minimum Pension (Basic) for each cadre right from Class IV.III ,II and Class I. The Honourable DHC also in the judgement dt 27-4-2017  referred this point and directed the LIC to comply.

I am sure that this point will be taken into consideration by our legal team .

With respectful regards,

G Ramamurthi.
