"Hope we have clarified all the points raised by you in your e-mail"
While thanking you for your response, I must say that your hope is
rather misplaced in that it gives rise to more questions than answers to
my repeated emails to you on the subject.
It is not that
I am unaware that you are simply carrying out instructions from those
above but since it is you who credited my bank account with Rs.65473.00
on 07-09-2018, you are morally and otherwise bound to give me convincing
answers to my questions and help me resolve my doubts.
At this point the courier delivered to me your 'detailed calculations'
which is just an elaboration running into 3 pages of your skewed
calculations given briefly in your response.
* The payment made is not as per Delhi High Court judgment dated 27/4/2017. There has been violations of the judgment by LIC.
*
The arrears have been calculated from 2007 while it should have been
from 1998 as per the order dated 27-04-2017 of the Delhi High Court,
vide para. No.109 on page 89 of the said order referrring to 'the date
of the first petition filed"
* The
deduction of the Interim Relief of Rs.65872.49 is in disregard of the
express mandate of the Court that 'Interim Relief already paid should
not be asked to be refunded'
* You
have calculated the enhancement in Dearness relief from 0.17% to 0.23%
instead of to 0.29% as per the order of the Court, vide para. No.107 (c)
on page No.89 of the judgment.
* What's
more, as if to rub salt into the wound, the method of calculation
adopted by you amounts to illegal deduction not only of the Interim
Relief but also of the interest on it by a devious ploy, thus subjecting
the poor, hapless pensioner to a double whammy on this head alone, not
to speak of the other tactics employed by you in circumventing the order
of the Court.
I do not claim to be an expert in this
matter but the aberrations made by you stick out so much like a sore
thumb so that even I, who am only a layman, can spot them a mile away
and am laying my queries and grievances before you as a layman,
reserving my right to revise them and add to them at a later date
depending on developments and circumstances as they unfold.
Meanwhile I should be obliged if you will kindly pay me the balance of "arrears" calculated the way the Court MANDATED it to be calculated (as listed above) and paid.
Thanks and regards.
