As usual, our Study Group, Legal Committee and the
Leaders in the helm are all in thick discussions within themselves as to how to
face the final hearings in Supreme Court, which are likely to commence from
26th Monday, this month. AIRIEF is determined to put forth our arguments on our
main demand of UPDATION OF PENSION and it is firm and careful in not falling
into the trap of the bureaucracy which is bent upon diverting our unified
concentration towards left out issues pertaining to Delhi High Court judgment.
Once the main issue is finalized, all other subsidiary items would
automatically get settled based on the full and final verdict.
Sri. C.H.Mahadevan, in charge of Retired Class-I Officers
Federation (Hyderabad) & Chandigarh Petitioners is of
the same view. However, AIRIEF would not fail to bring to the attention of the
court the gimmicks played by LIC in implementing the verdict of DHC according
to its own whims and fancies and more on unlawful
interpretations. But our main thrust would only be upon
our demand of updation of pension. We hope, our champion, Sri. Asthanaji would
certainly fall in line with us. We also hope that other organizations too
consider our stand and cooperate with us in the interest of all cadres of
pensioners — retired from inception of the Pension Scheme till today and
thereafter.
It is also in the minds of our elite leaders that efforts
should also be made to see that the hearings should go daily uninterrupted and
that we should complete our result-oriented and flawless arguments before 30th
November and also to obtain the final judgment before 14th December, since
Christmas holidays would commence, thereafter. Incidentally, Hon’ble Justice
Lokur is to retire at the end of December. So, AIRIEF is keen on securing the
final favorable judgment on all counts before 14th, December. AIRIEF will
certainly plan its move in active consultation with our Sr. Advocate Sri.
K.T.S. Tulsi, through our Advocate Sri. R.K.Singh. More you will come to know
of the above in due course.
Should we not instantly rise up to this occasion and
extend all our support to AIRIEF at this juncture ? How ? Activists with their
legal knowledge and experience have kept on forwarding legal assistance all
through to our legal committee. We, on our part, used to pass on contributions
to our legal fund then and there. But, we cannot deny that our participation
towards this obligation was not that much expected. Despite repeated appeals
from our President,General Secretary, Organizing Secretary and other OBs, the
quantum of amount received so far appear to be not equal to the size of the
membership strength of such Divl.Units. Fact remains that certain quarters are
not at all interested in this campaign, but still are eager to know the
progress of our case. Some members might have contributed some amount initially
and thereafter they appear to be silent. Probably, they might have disappointed
over the prolonged legal fight. But, we cannot avoid this delay due to the
following reasons: 1). Ours is a civil case; 2). We are able to conduct our
case with what best we could spare for legal expenses; 3) As our members are of
a scattered group wielding no influence over the ruling sect, they give little
importance to our demand; 4. The total voters-strength of all the
pensioner-organizations does not enjoy the status of ” Deciding Factor ” in the
Elections, etc, etc.
With all the above deficiencies, we are able to withstand
in our efforts and take our issues to this level. Had we had sufficient funds
with us, we could have engaged a set of eminent Sr.Advocates and won the case
long before. You will all agree that the bureaucracy had engaged Additional
Solicitor Generals. one after another, with the full backing of UOI, to
influence the courts in getting adjournments. Last time we engaged one more
influential Sr.Advocate along with our Sr.Advocate, Sri. K.T.S.Tulsi. The Bench
had to adjourn again on the plea of the bureaucracy through some other Addl.
Solicitor General. Our case has come to the final stage. Fund resources should
be sound to meet out the fee for the advocates for all the days of the hearing
till our case comes to the finality. Other expenses are there for the travel,
boarding, lodging and incidental items.Our rank and file should consider this
lacuna very seriously and start to augment the financial positions
considerably. We cannot leave a winning case for want of funds. Every member
should touch his conscience and swear that he would not allow the case to be
lost for want of funds. Let the flow of fund commence from all quarters right
from now on. Divl Secretaries should contact all the members , explain the need
of the hour and convince every one to join this main stream.
Let us face the onslaught of the notorious bureaucracy
with our unrelenting UNITY. Long Live AIRIEF
