I attach the decisions of the CIC on my two Appeals made against denial by LIC of information sought by me in 2018 which came up for hearing on 20/1/2020 through Video Conferencing and I attended the hearing from Chennai by VC.
The first one relates to the method of calculations of average emoluments and basic pension for pensioners covered by Rule 55B.In the Written Submissions made by LIC,it has been confirmed that calculations are made for this category of pensioners under Rule 49 of the CCS Pension Rules 1972 and submitted to the the CIC that if LIC had provided this information at the first instance,I would not have submitted this appeal.I submitted that the information provided in their WS will serve my purpose.
The second Appeal relates to the nature of Additional Pension components of Pension.Just before the hearing,I got the message from Mr M P Agnihotri that the related information is available in the information provided by LIC to Mr N K Upadhyaya of Jabalpur through CO circular dt 5/7/1995.CIC has directed LIC to provide to me a copy of this circular.
In a way I believe that my Appeals have helped to expose the routine and casual manner in which information under RTI Act 2005 are denied to applicants by LIC before the CIC.
The information in the WS of LIC relating to Rule 55B ,I am sure will help in establishing before the SC the discrimination created in the LIC Pension Rules two categories of pensioners covered by the same Pension Rule 1995 attracting the ratio of D S Nakara case.judgment.
Let us explore how well this information can be put to use in our legal fight.
