This
means that the scales of pay for Class I Officers are effective from
1/8/1992 for all purposes of other benefits except that no arrears are
payable to the officer for the period from 1/8/1992.
For
example,if the increment of any officer fell due on August 1992 or any
subsequent month upto 31/3/1993,the next annual increment should fall
due exactly 12 months after that date even though LIC would have paid
the revised salary only from April 1993.
Secondly,for M C Jain
category retirees,even if arrears were not payable upto the date of
their dates of retirement,irrespective of the judgment of the Jaipur
Bench ,all these retirees should have been notionally placed on the
revised Basic Pay from 1/8/1992 and their Basic Pension should have been
calculated accordingly payable from 1/11/1993.This should benefit all
the 325 retirees in the M C Jain category.
There is a
difference between stating that no arrears are payable from 1/8/992 to
31/3/1993 and saying that wage revisions for officers are effective from
1/4/1993.Wage revision for Class I Officers is also effective from
1/8/1992 sans arrears upto 31/3/1993.
My view is that wage
revision for Class I Officers is effective from 1/8/1992 and only
arrears are not payable for the period August 1992 to March 1993.
We need to take up this issue again with LIC Management for proper interpretation of the Gazette Notification.
