Dear Sirs, ( google and press news.)
Re- Hon'ble Justice D.Y.Chndrachud on Tuesday, 1/6/2021 said to the effect
that of the cases brought before the vacation bench are "frivolous"…..etc.
"Hon'ble S.C. Judge Justice D.Y.Chandrachud , on Tuesday, the 1st June, 2021 said that 95% of the cases brought before the vacation bench are "frivolous", which were taking away judge's time and attention from cases of national importance."
"The observations were made by Hon.Justice Chandrachud at two instances as the court refused to entertain the petitions that had been filed on the grounds that they were frivolous . Even as the Lawyers appearing before him insisted to be heard, Justice Chandrachud said " we should not encourage this. Out of all the matters that we have before us , 95% of them are frivolous, including this one. All of this time could be devoted to more important issues."
"He continued that the system was becoming dysfunctional because of the frivolous matters."
"We wanted to upload the Suo Moto COVID order today, but were unable to do so. Please respect the sanctity of the Institution.This wastes the time of the court and suggests that judges have a lot of time. This is also the tax payers' money that you are wasting" stated Hon.Justice Chandrachud.
WE have to appreciate above observations of Hon'ble Justice Chandrachud .
=================================
With regard to the above, I am reminded of (1) National Litigation Policy, formulated and declared on 24/6/2010 in the regime of UPA Govt., by Dr.M.Veerappa Moily, Minister of Law and Justice , its replica is again reproduced in the matter of Union of India & Ors.Vs.Prithvi SingOrs.dt.24.4.2018.This Policy runs into 11 pages; and (2) National Policy On Older Persons, announced by the Govt. in 1999, declared as the International Year of Older Persons by the UN. The year 2000 has been declared as the National Year of Older Persons by the Government of India. The decision to frame a Policy for older persons was first mooted in the '80s, following the World Assembly on Ageing held at Viena in 1982. In1987-88, an Inter Ministerial Committee was constituted by the GOI for this purpose. The process of formulating the policy gathered momentum in the two years preceding 1999. This Policy runs into 18.pages. This policy was followed by National Policy on Senior Citizens, headed by Dr.Mrs.Mohini Giri, Chairperson with Members : Mr.M.M.Sabharwal, Mr.K.R.Gangadharan and Dr. Sheilu Sreenivasan.And Member Secretary : Mr. P.P.Mitra.
I would like to request you to kindly examine how far above two Policies would help us in our battle in Supreme Court.
With best regards,
G.T.Parikh.
(NOTE:- It is not practically possible for me to give contents of both the Policies but you may kindly make a search in google. Thanks).
