Reg: Our case in the SC today
As you may have known by now, our SLPs were listed for Hearing on the 7th of July 2021, ie., today ,in Court No 8 under item 14. The information came to me only on the 5th of July 21, and all on a sudden we had to crank the machinery and get ourselves battle-ready. We could of course talk to our Counsel and send in brief Notes refreshing their memory on the important points involved.
This Hearing on the 7th of July was again on the Virtual mode, with the counsels on both sides being seen on the screen, and of course the Judges in the centre of it all. When our item 14 came up, the judges asked the counsels whether they are ready for the arguments which could be in some detail. Since Notice period was rather low, the Counsels themselves, on both sides, were not too keen that it should necessarily be taken up today itself. So the Judges said we would fix another date after 4 weeks. So here was an Adjournment almost bargained by the Bench itself! I was a bit happy that the case was not rushed through with undue haste, as we have been waiting for an unduly long period, though at very senior age, as Pensioners. Secondly, our own preparations could be that bit better with a little more time. Sri Nidesh Gupta, Sr. Counsel for AIRIEF, did point out that the pensioners are all in advanced age groups and delay beyond the 4 weeks suggested would be hard on them. The judges realized that this item cannot be rushed through fast like the other 13 items, that were blown away in less than an hour. It is also reliably understood that the judges have, at an informal level, suggested that some brief Notes covering the essential points in the Case could still be submitted, though not in the form of an Affidavit. I think they would like to get a grasp of the core issues in this rather complex case involving a number of basic aspects.
We could view the proceedings sitting in the comfort of our Home, because the link to view it on our computer was provided. I had some ideas about virtual mode of Hearing, which were not very positive. But I now observe that it is much easier to follow the discussions, and even Record it with the video pictures, if necessary, and all counsels on the screen find it easy to chip in where required. And the main thing is that we need not spend big money to visit Delhi to be present for the Hearing.
So, we will now live with this inevitable time delay, because ours is no push-over matter, to be quickly heard and decided on.
