On 1st September when we were celebrating 65th Anniversary of the gigantic institution LIC, I came across an Air Veteran's Basic Pension was fixed wrongly by LIC Divisional Office, BELAGAVI. The Service in LIC was taken without inclusion of Training Period as 24 years and accordingly Basic Pension was fixed. On adding his Training period the Service to be counted for Pension worked out to 25 years and hence there is short fixation Basic Pension to the tune of Rs.872/- pm. The consequential difference in Commuted Value and Arrears of Basic Pension (after Commtn) and DR on that is payable to him, apart from the difference in Gratuity calculated as per Staff Regulation..
Yesterday, he has submitted 2 letters to SDM, LIC, DO, Belagavi asking the Office to reopen the fixation of his Pension and recalculate the Pension taking into account the Training Period as per Rule 20 read with Rule 19 of the LICEPR, 1995. Another letter was to pay Gratuity difference as per the Staff Regulation, again taking Training period for the Calculation purpose.
I thought there may be many more such cases in the entire country and hence this message to all the Veterans and also to non-vetarans who have retired before completion of 33 years of Service and those who have taken VRS before completion of 28 years of Service. Please check up your Pension calculation sheet.
At the time of Retirement every one must have been given Pension Quotation. This contains your Date of Probation, Date of Birth and Date of Retirement as also the Number of EOLs during your entire service. Recalculate your total Service adding Training period, calculate the total service from the Date of Training to Date of Retirement, deduct the number of days on EOL (it is mentioned under Sl No.8 of Pension quotation) and check whether the number of years of Service as per Rule 20 &19 of LICEPR, 1995 works out same as taken by Office or it changes. If the service as calculated above changes, then give a representation to the concerned SDM requesting to reopen the Pension fixation, recalculate the Pension after adding Training period and refix the Pension and pay the consequential difference in CV and arrears of Pension.
My appeal to every one of you is to see that this message reaches each and every Pensioner mentioned in the 3rd paragraph above.
I also request all Divisional Units to publish this message in their WhatsApp groups so that it reaches maximum Pensioners.
The relevant provisions of the LIC (Employees) Pension Rules, 1995 are given below for your ready reference. Proviso to Rule 18 States as :
i) periods of EOL on loss of pay except as otherwise provided herein ;
ii) periods of unauthorised absence except as provided in rule 28 of these rules ;
iii) ................. shall not be counted as qualifying service.
Rule 19 :
Broken period of service of less than one year :
If the service of an employee includes broken period of service of less than one year, then if such broken period is more than SIX months it shall be treated as one year and if such broken period is six months or less it shall be ignored.
Rule 20 : Counting of period spent of training :
Period spent by an employee on training in the Corporation immediately before his appointment or re-employment or re-appointment shall count as qualifying service.
