Payment of Difference of CV to Family Pensioner and option to commute lesser fraction of Revised Basic Pension by the Pensioner

My opinion on the above issue of CV payment to Family Pensioner on the death of the Regular Pensioner :

1. If the Wage Revision would have taken place on 1-8-2017 itself, what would have been the position ?
He would have been paid CV on the New Scale, since he has opted for CV.
2. The employee / Pensioner is in NO WAY responsible for delay of more than 45 months. It is LIC / GOI responsible for this abnormal delay in Wage Revision.
3. Even in case of Regular Pensioner, whether LIC is accepting reduction in Commuted portion of Pension after Wage Revision, Kindly check up.
I don't think reduction is accepted. So, obtaining Annexure IV is redundant.
They are settling CV based on the option exercised at the time of retirement.
4. Rule 3(5) of Pension Rules lays down a principle, which 'mutatis mutandis' is applicable here also.
5. For some body else's fault, why Family Pensioner should be punished ?
6 *Therefore it is my firm opinion that Family Pensioner should be paid difference in CV.*
7. There may be very few cases - all over India - falling  in this category, but whatever is legally due should be paid.
