I have gone through the contention of respected Shri C H Mahadevan ji. My submission in respect of 35(1) is that we should not relegate this Rule as a one-off provision. Even if the respondents argue on these lines, we would have to strongly contend against this line of argument. Further recent SC judgment ruling that whenever a rule can be interpreted in two different ways the one which is favorable to the pensioners would have to be accepted.
