The judgment has emphasized the ratio of DS Nakara case judgment of SC.But as this is only a HC judgment, we have to wait and see whether the Respondents will approach the SC.
The reasoning given for the judgment can be used appropriately in our case in SC in respect of 100% DR neutralization,same rate of DR for retirees as rate of DA for serving employees, and different classes of pensioners created by Rule 55 B for giving more liberal treatment for one small group of beneficiaries of LIC Pension Rules 1995.
