Re: Administrative Instructions for implementation of Order of Kerala High Court in WA No 417 of 2020 in WP© No 39134/2017
We have to invite your kind attention to the letter of the Executive Director (Personnel) vide Ref: Per/ER-A/Revised Pension dated 6/6/2024 on the aforesaid subject and request as under:
As the beneficiaries are the pensioners who retired between the period from 01/08/1992 to 31/03/1993 and their family pensioners, recovery of the commuted value wherever opted, had already been completed and therefore the arrears of the difference between the re-fixed pension and already paid pension, with effect from Nov. 1993, should be paid without taking into consideration the commuted value.
Re-fixed Pension from 08/1992 to 03/1993 would impact the average emoluments of the pensioners who retired after 31/03/1993, as out of ten months before retirement date, some months would be falling during the period from 01/08/1992 to 31/03/1993. This situation would be in respect of the employees who had retired up to the month of Nov. 1993. Therefore, the benefit of the re-fixed pension as per the court order should be given to such pensioners also.
We hope our submissions as above will receive your favourable consideration and the benefits are settled to the surviving retiree officers and nominees/legal heirs of the eligible deceased officers as we believe a large number in the group might have passed away by now, being in 88-90 years age group.
