Kerala HC Judgment beneficiaries-Non-supply of calculations of LIC

VERY IMPORTANT
There were about 325 retirees who were entitled to receive arrears and revised pension as per the Kerala High Court judgment dated 7/2/2024.
As per information reaching me, payments have been made to some surviving retirees and even nominees/legal heirs of deceased retirees, but no calculations have been provided by the offices supporting the payments. In some cases of those retired on 31/8/1992,they have been informed that recoveries are there instead of arrears, but no calculations have been provided.
I have a hunch that the payment of difference in commutation value of pension is responsible for short payment of arrears and perhaps recovery in some cases.
I therefore suggest that the concerned beneficiaries should insist on supply of written calculations from the office.Letters written in the normal course may not evoke prompt response from the office and so it is desirable for the beneficiaries to file  an RTI application with  the concerned PIO of the office which paid the arrears/ informed recovery. When  RTI application is made , the PIO has to furnish the information within one month.Once  the calculations are received from the office, it will be possible to check for mistakes in calculations and demand the  payment of  difference due if any.
If commutation value difference has been included in the calculations, the beneficiaries are entitled to demand from LIC, interest on commutation difference from 1995 till the date of payment  of arrears taking due credit for interest on monthly instalments recovered for 15 years.
The various Associations of pensioners should guide the beneficiaries in filing the RTI applications to the concerned authorities in the pension disbursing offices.
