PENDING PROBLEMS,ISSUES& GRIEVANCES of PENSIONERS

 Dear All,


 PENDING PROBLEMS,ISSUES& GRIEVANCES of PENSIONERS: Resolve to lighten ELDERS BURDEN.  DATA BANK & THINK TANK continuously needed for Fedns to SURVIVE & SURPASS.


           POSSIBLE, MANY MAY NEED RECOURSE TO LITIGATION,JUDGED BY PAST EXPERIENCE,DELAY etc



1)Notional length of service to be added with 5 years for FULL Pension by challenging the denial of benefit of Rule 27,Addition to Qualifying services ,as,now they get LESSER Proportionate Pension only 


2)In the event of death of Regular Pensioner,Family Pensioner must get Full.Regular Pension ,till age 67,instead of existing 65 years.(when Retirement age was 58)


3)To get existing Govt rules of 20 Years service to qualify for Full Pension ,to us also legitimately 


4)Age relatedValue addition to Basic  Pension on Govt pattern of 20%,30,40,50,,&100% at ages 80,85,90,95&100

    ** Govt has also offered  Basic Pension addition.by 5%,10%& 15%,at Ages 65,70&  75 & to synchronise further from 20%at Age 80 with already existing Age-related value additions


5)Gold coin issue still open.SriAsthana(late),steadfast,indefatigable warrior fought convincingly,when Employees as also those on probation were given for Golden Jubilee of LIC,1 Sovereign Gold coin, Pensioners ,in Rajasthan HC,Jaipur pleaded for equality ,but pittance of cash award only allowed ,with power to pursue to avoid discrimination.


6)Diamond Jubilee Year 2016-17 for LIC in September,nothing granted, for Employees too


7)1st DATE OF BIRTH Pensioners to get benefit of PAY for THAT MONTH too,. Govt accepted,had implemented ,as a RULE & principle but LIC allowed ONLY  for the PETITIONER.


8)*MCJAIN CASE RMAccts ,Jaipur ,with Sri Asthana's Rajasthan HC WP scored a Victory,taken to its logical acceptance by LIC & Payment of arrears to the Petitioner only done. (Class 1 retired between 1/8/1992--31/3/1993 All India around 350 such cases,),Mr CSMurty (late) former GS AIRIEF,Redoubtable ,FUP persistently at Kerala EKLM HC ,adjournments galore,MGT adamant not to extend to others,ATLAST Kerala HC verdict now ,extended to ALL SUCH as a matter ofcourse Upholding equality & eschewing discrimination.

Calculations of fitting New Enhanced Pension wef 141993 to date CO Circular is being followed All over ,BUT aged 90 & above, many would have died,ZO  is unable to give Perfect data gathered so far,even when Numbers are Minimal.Arrears for so long wef 141993 to date of Calculation looks low.

      RIEAs must meet Mgr OS, CO Per /IT SD must assist & resolve the issue without any further delay.I requested RMOS,SZO ,MEANTIME to update Nominee/Alternate Nominee if Registered ,as Prudence demanded,many must be above 90 years.

RIEAs must immediately FLASH LATEST DATA to ZOs & help POSITIVE attention & focus & Empathy & NOT to SHELVE,which can happen.  In fact,SZ Tamilnadu Chennai,Our Book shows  67,OSZO Data shows 57.Why should we forget those 10,NOT AT ALL, NAME to Name, Records must tally & those 10 should be written to RESPOND. 


9)Cases of Voluntary Retirement & Resignation to get justice of Pension as is allowed in Banks .


10)Reconsideration to atleast allow those Pensioners who positively want LOWER OSA  as  MANY FPs cannot afford Existing high premium from their meagre Family Pension


11)Domiciliary Benefit ,CMB Cash Medical Benefit  must be allowed,deserving for Pensioners on SAME SCALE as is being offerred to Employees with YLY Amount specified .For the latest wage settlement wef 1/8/2022 , CMB per Annum ranges from Rs 16,250 for Class3 & 4,Rs 20,300 for Class 2 Dev Officers, & for Class I  Rs 32,400 for Officers with Basic Pay upto Rs1,63,905 & Rs 48,500 CMB for those above Basic Pay of Rs 1,63,905 .This will be a BOON for Pensioners ,as NO Domiciliary Benefit, Sr Citizens & Super Sr Citizens,meagre pension is eaten away by Doctors Consultation Fee,Medicines,Injections, Special Reports,2nd round if not fully cured,Spouse similar condition to restore well-being. In fact,more than Employees,it is Pensioners Fraternity which badly needs IMMEDIATE ATTENTION & CMB announcement with grace & empathy. 

      STRANGE,even within Organisation,somehow delay, in spite of Persistent ,FACE to Face fup, TALK,EMAIL to TOP Mgt,MEMORANDUMS regular to ZM,RMPIR,RMOS,SDM DOs & 


        YET ANOTHER DICHOTOMY & UNTOLD,UNPARDONABLE DELAY between GOVT or Banks or RBI Pensioners etc CAUSING UNTOLD HARM, DISCRIMINATION,LOSS for Pensioners,One,yet PROCRASTINATION. OUTLAY ,say Rs200 cr pa must be allowed for CHAIR PERSON LIC,yet, as LIC,UNLIKE BANKS does not enjoy STAFF WELFARE FUND,SBI Rs200cr,may be more Now)


12)Preventive Health Check up,even Limited from age 60 at regular intervals with Checkup Reports  as Yly Allowance,which will reduce FutureHospitalisation &  high expenses,many do not claim amounts for fear of elaborate  Claim Forms,ZO/DO OS  Mediclaim must instantly prepare YEAR END MACRO,MICRO ANALYSIS NUMBERS, SA, Separately for EMPLOYEES & PENSIONERS.Aim should be for HOLISTIC HEALTH & WELLBEING.

     EVEN amongst DIVISIONS,, wide Variations I noticed  in one  FULL RECORD Persistently fup,secured. WHITHER DATA BANK & THINK TANK .When,Where,How LIC AVAILS   AI Artificial Intelligence to supplement NI Natural Intelligence ,avoiding  DANGEROUS PITFALLS of some Aspects of AI ,


13)Those availing CASHLESS FACILITY  STATISTICS NEEDED to assess Progress, Year after Year  NUMBERS & AMOUNT.

.    i)FAMILY PENSIONERS must be a worried lot. NEW,CREATIVE, PROGRESSIVE Steps required.Groups of FP Meet must be arranged Periodically to elicit grievances,gather data,resolve then & there,  ii)call in late August Yly for FPs, Life Certificate,after verification of Basic Aaadhar ,PAN Card etc & Authorised Signatories assembled ATTEST happily,what a relief.

**iii)So too,Call for Pensioners ,including FPs for presentation by TPA Officers  on Group Mediclaim,Questions & Answers & any Suggestions for proper implementation.

***Time has come,when CGovt has initiated many NOVEL Strategies, a)Select Postman ,as thorough with the Addressee,after proper & sound  verification, accepting,approving LCs,became a Mass Movement. b)SO too, BATCH of Officers & Staff, visiting BED-RIDDEN Pensioner patients IMMOBILE,after eliciting Basic info & authenticity,Certify LCs

****c)Certain & Sure,will be VIDEO Calls ,PhotoIdentity established,quick disposal of Certification, d)any number of Pro-Pensioner Healthy & Empathetic Measures of their own.  

    One can characterise OS/Pension/Mediclaim Dept  as a STATIC  Dept,wanting to hide in GENERALITIES,(as perhaps Ready Manual does not exist or Practices not CODIFIED ),PLUS even Audit & Inspection Report  does not throw INDICES to INVENT BREAKTHROUGH than  CREATE A NEW VISTAS for rapid progress ,to EARN EASE OF LIVING & ENABLING ENVIRONMENT .for ALL Pensioners, DIRE NEED.

  Telephones right from RMOS,SYOS,ASOS,ASY Mediclaim,AOOS, NOT picked up is NOT CUSTOMER THRILL OR ECSTACY..

EVEN after sending EARLIER CO CHIEF Per Circular dt 4/6/2012,where once for all CO cleared doubts on Exgratia payments ,that ,when once Officer is promoted to Higher cadre /Scale & Higher cadre fixation done,THAT HIGHER CADRE EXGRATIA amount only must be paid & NOT BASIC CADRE Amount indicated.YET NO ACTION,Regrettable 

**Deaths of Pensioners ,converted as Family Pensioners ,that LIST for RIEAs to offer heartfelt Condolences,to observe 1 Minute silence for the departed soul will be needed for every FY. Infact,moment,after mourning period is over,Nominee/Claimant submits requirements for Family Pension,Assns can be informed to enable them to pay tributes & words of solace & comfort to the Spouse etc. 


14)The issue of ANAMOLIES  for EMPLOYEES who RETIRE WITHIN 10 MONTHS OF  EFFECTIVE DATE OF THE IMMEDIATELY PRECEDING WAGE REVISION:

W e pointed out  that GOI DEPT OF PENSION GRIEVANCE compelled IBA  to IMPLEMENT,when  2nd PENSION OPTION was granted,as they failed to implement,UNIONS OBJECTED,& SUCH ANAMOLIES  DISAPPEARED,THANX to FIXING LAST DRAWN PAY OR AVERAGE 10 MONTHS WHICHEVER IS HIGHER.

      WHEN GOVT AGREED IN 2009-10 ,2ND OPTION BENEFITTING 3.30 LAKHS OFFICERS& WORKMEN IN INDUSTRY,WHY NOT LIC ALSO ALLOW SUCH A CLARIFICATION ORDER SETTING RIGHT SUCH ANAMOLIES,WHICH WILL ONCE FOR ALL, RESOLVE this  LONG-PENDING GENUINE GRIEVANCE.     

One offshoot of this PERTINENT POINT is in Todays WORLD,when EFFICIENCY & EFFECTIVENESS must be the WATCHWORDS, when ALREADY LIC BOARD RESOLUTION No 499  for the ACEPTANCE & BR 500   for Enhancing Family Pension to 30 % of BASIC PAY of the deceased Pensioner ,not Staggered as was before,which was accepted by DFS/GOI & LIC implemented from September 2023 Pension paid on 1st October 2023,   why   STILL BR No 499 ALREADY in vogue for large volume of CG pensioners, not Implemented smacks of NEGLIGENCE &  SCANT REGARD for PRINCIPLES, ALWAYS Effective Date Varying ,causing IRREPARABLE MONETARY  DAMAGE to SUCH LIC Pensioners.SAME can be narrated for EFFECTIVE DATE for RETIREMENT BENEFIT GRATUITY ,always gravitating in favour of PAY COMMISSION DATE 1/1/1996,1/1/2006,1/1/2016 &for us GAP of MANY MONTHS,YEARS too.ALL SUCH GROSS DEVIATIONS, ANAMOILES must be GROUPED as  a SINGLE PETITION by AIRIEF BEFORE HC or SC as ENORMOUS DAMAGE must be LAWFULLY,RIGHTLY,ON BASIS OF EQUITY,EQUALITY SETTLED & SC will CERTAINLY ALLOW,PASSING STRICTURES ABOUT DFS/MOF/GOI


15)  PENSIONERS PORTAL  INTRODUCED after persistent reminders ,unpardonable delay,PARTIAL FEATURES ONLY,NOT HOLISTIC FOR EVERY PENSIONER ,MUST BE FULLY USER-FRIENDLY  ,SURFING ,GETTING EACH & EVERY FACET OF PENSIONERS NEEDS WITH A CLICK,

JUST AS We get ALL DATA RE POLICIES,PREMIUM,BONUS,PUV, SV,L0AN VALUE,LOAN INTEREST HLY,

SO TOO PENSIONERS MUST GET ALL ABOUT PENSION,REGULAR,FAMILY, DR SLABS,MEDICLAIM PREMIUM,CERTIFICATE OF PENSION PAID,FORM NO 16 OF FY,ALL CIRCULARS,PENSIONERS HELPLINE REPLY IN 48HRS,,FACILITATE EASY  CONTACTS BY ONE ANOTHER,GREAT EMPATHY,GET FORMS FOR  SPECIFIC PURPOSES TO BE DOWNLOADED,Life certificate,Form of Nomination with Alternate Nominee,Videocall for identity & easy acceptance of LC  

16)COMPULSORILY RETIRED EMPLOYEES ENTITLED TO FULL PENSION,IN BANKS:

  ACCORDING to PENSION REGULATION 33,in case of employees who are compulsorily retired,the Banks have discretion to reduce their Pension upto 2/3rd of  the normal pension,Whereas ,according to an Amended provision of  Bipartite Settlements,Employees in such cases are entitled to Full pension.BUT since the corresponding amendment is not done in the Banks Pension Regulations,some of the Banks are used to grant Reduced   Pension . SUPREMECOURT ,RECENTLY IN DECIDING SUCH A CASE of  LATE Sri S.K.Kool v/s   BANK OF BARODA,HAS DIRECTED THE BANK TO PAY full pension with 6 % interest from Retrospective effect.A cost of Rs50,000 is also awarded to the Employee.Since the Retired employee has expired, the Widow got the benefit.

Secretary Pension &Regd Pensioners AssnsVideo Conference 24/5/23.SECRETARY clarified that the payment of last increment accrued to the Pensioners retiring on 30.06 of every year& Reduction of period of Commutation from 15 years to 12 years  are Rejected by the GOI & only next PAY Commission shall consider these issues.

STRUGGLE  to get the VIII CPC must be intensified,says AIFPA     


18)LET THE ASANSOL GENERAL COUNCIL PASS 4  WORTHY RESOLUTIONS I SENT  ELUSIVELY  MISSING TARGET & ABOVE HEARTBURNING ISSUES, GENUINE converted as RESOLUTION 5 TO GROUP such SURE CASES NOT DEMANDING TIME or FURTHER PROCRASTINATION & SO  CAN BE QUICKLY SETTLED with Court INTERVENTION.23,500 Pensioners dead & are dying ,their Nominees or Heirs will thank AIRIEF FOR SUCH NOBLE ACTS OF REDEMPTION & RECTIFICATION so LEGITIMATELY DENIED SO FAR WITH UNBRIDLED POWER OF GOVT,IGNORING  TREMENDOUS MENTAL,FINANCIAL DAMAGE they are CAUSING for the WEAKEST SECTION of SOCIETY.

EQUALLY, WHEN our SR ADVOCATE pleads FINALLY with gusto & SANE ADVICE of Chairman Legal Study Group,Sri MPAgnihotri , that when FINAL VERDICT & ORDERS come in Pensioners favour, those Pensioners who are NO MORE, must DERIVE FULL BENEFIT allowed from Effective Date,their Nominees/Heirs legitimately MUST GET announced BENEFIT of SC ORDERS in TOTO,please.


 FAITH & PRAYERS ,LEGAL FUND must continue to be COLLECTED & HARNESSED for EACH & EVERY GRIEVANCE OF REGULAR & FAMILY PENSIONERSe HONOURED IN LETTER & SPIRIT
