The Chattisgarh HC held that pension is earned property right and not a bounty

The Chattisgarh HC judgment in WPS/4181/2021 is forwarded in the following link.

The HC held that pension is earned property right and not a bounty and ordered the employer viz, the State Government to refund Rs 9.23 lks recovered  without following due process and without considering relevant facts, to the legal heirs of the deceased petitioner-pensioner.

Now, it has to be seen whether the Chattisgarh State Government will appeal against the judgment in  the Division Bench  of the  High Court and pursue  the case further .
