Clarifications recieved on the query of shri V. Gopalan

I send herewith my mail addressed to M/s CH Mahadevan and Sreenivasa Murty on the DR formula for pensioners and Final Listing of cases in SC as also the clarifications rec'd from them.

Dear Mr Mahadevan
I have seen your latest post on the above in PC.
The record of proceedings says "in line with the DA formula in operation in LIC of India" and does not say "in line with the DA formula in operation in LIC of India for serving employees". Is it safe to assume that it means "same DR for pensioners as available for employees"?
We are again and again being assured that we will be listed No. 1 in next hearing. But so far, invariably our case is listed as 101 only after half a dozen of misc cases. Then what is the meaning of being listed No. 1 and being passed over every time for another day. Listed NO. 1 should result in our case being taken up first in the day's proceedings immediately after the Bench assembles for the day. Then what is this magic No. 101 which leads us to conclude it is No. 1? Invariably 101 is listed only after 1, 2, 3, 4, 5, 6 etc?

Final listing numbers are from Sl No 101 to 120. (only 20 cases).  None from from zero to 100. Above 101 will be a couple of For Judgement cases which take 3 or 4 minutes and a few Miscellaneous cases. The uncertainty is all about these Miscellaneous cases as it happened on 21st. 
Sometimes, The Bench may start with Sl No 101 without touching any of the Misce items. Let us hope that will happen on 4th February. Thanks and regards,

We are very safe in assuming that as(i) DA was referred to in 1994 in the context
of employees as pension scheme had not been notified, &(ii)Dearness Relief is
always referred to in relation to pension.
