M C JAIN CASE


Dear Mr Ramanathan,
Thank you. I got the information from Mr R K Sahni earlier. He had also given the figure of 117 for Nov 1991 which is relevant for working out revised average emoluments for those who retired in August 1992.
As you may be aware, in the case of Mr M C Jain,LIC had paid a pension arrears of only Rs 12242 being the pension difference from 1/11/1993 to 31/1/2015( including CV difference).
Interestingly there is a negative difference for 180 months from 1/9/1995.They have not paid any interest on the CV difference with the result that the total of the monthly deductions towards commuted pension works out to 60% more than the CV difference.
He has, in addition, neither been paid the difference in refixed salary from Aug 1992 to Jan 1993 nor the difference in PL encashment amount due at the time of retirement as a consequential benefit.
Although he has a strong case for filing a contempt petition, I understand that he doesn't intend to proceed legally further. May be he would rather wait for the outcome on the CAs before the SC.
