1)Dear Sri Ramanathan, I could not reply to this with my observations, as I had to send Pensioners Emails  &Feedback from 16th May 2015 Series No 102 without fail. I accord importance to some definitive work I had undertaken of my own as VP, AIRIEF.That itself is backbreaking & consumes enormous tome.Futher, to speed up matters,I fup with CO Top brass to keep alive the concern LIC CO has to demonstrate & resolve such vital issues
2)On important matters, we have to give immediate comments on news as they develop & keep in touch with mainstream devpts, be it RBI or Bank settlements etc, as I have connections with them
 
3)On top of it, 15 days before I spoke to our ZM & told him, whatever the vigilance angle rules of sensitive posts who have to be shifted,or CVC dictat, I emphatically stressed that OS & Pension Cell need not come under that purview ,but Estates, Engineering or any other  can as Stakeholders interests have also to be borne in mind.He told me it is not LIC CO but CVC dictat.That is how mechanically rules are laid down
 
4)I started talking to RMOS, wrote to him too, he is a loveable character, very efficient,also to Sy OS Sri Govindarajan.  I also told both to refer to old files of all embracing talks for 2.5 hrs with ZM & ALL OS officials & Mgrs DO 1 & 2.As ,Revathy AO(OS/P) reported  early, I educated her, told the DOs she has to trim with fup, talk to Sy OS, CBE, TVLI not crediting 1st Pension amount,even yesterday when there was delay, I reminded her, she humbly told 2 days before she went to Corporation Bank with all data
After I told the predicament she spoke to Corpn Bk & they confirmed they sent in 2 instalments FN/AN etc.It is shocking how DO 1 has delayed.We are better off as SriRKSahni when  I asked him told Karnal is crediting Mediclaim premium next week.I am not aware of pension credit
Strange even Data re Pensioners ,CO is not able to provide. I spoke to EDP 10 days before, to ED/OS 3 days before.All these consume lot of time.after retirement, I am Chairman to Chaprasi.I work on my own volition. Everyday,late sitting  is too harsh a punishment I have inflicted with attendant health hazards mounting .
 
5)Look at pensioners response..When I sent emails 15 days before to CBE, TVLI, MDI select pensioners 2 each to tell me the DATE OF CREDIT of pension, only 1 from MDI immly sent email.CBE ,TVLI who knew earlier Angurajan & myself were fup with ZO kept mum.That shd not be the case;Look  at hits of AIRIEFWEBSITE ,so many appeals,Even normal disciplined pensioners dont participate,don't request to their friends/pensioners emailids to visit the eternally useful website.It is for their good. Progress cannot be a one-way affair.  Now all want a CONFEDERATION !!
 
6)Revathy is sensible,responsive & replies immly & fup. Of course, state of affairs varies from DO to DO

2)Dear Mr Sahni,                   TO DECIDE OR DRIFT?
Referring to the post of Mr A V Subbaraman,in all probability LIC is not likely to comply with  the SC order dated 7/5/2015 before 18/6/2015.As it is, no contempt proceedings are possible  before 1st July 2015 during the summer vacation of the Apex Court. While LIC is not apparently worried about the contempt petition that may be filed against it, there is nothing that the pensioners can do till 23 rd September 2015 when the next hearing of the Civil Appeals will take place or till any approach is made by LIC before the Apex Court In the meantime for clarifications of their 7th May 15 order and/or extension of time for complying with that order.
If LIC/UOI has to be made to accord priority to pensioners' cases, there is no alternative to all the three sets of original petitioners joining together as one potent force and initiating  contempt proceedings against LIC's  senior functionaries in the event of LIC not implementing the SC order before 18th June 2015.On the other hand if the three parties continue pursuing  their own  agenda  as at present, things will move at their own pace with no end  in sight for the  present travails of pensioners , especially those in their late seventies and eighties.
Let us not forget that the political climate is not too favourable for LIC pensioners as is seen from the marginalisation of Bank pensioners in the 10 th Bipartite Settlement signed on 25 th May 2015.
 Sticking  to egos may provide personal satisfaction for individuals, but cannot help achieve collective benefit.

Your kind and detailed message of yesterdate addressed to me touching on your painstaking efforts day & night on various issues affecting the growth of our Mighty And Functioning Organisation and the welfare of hapless pensioner community. None needs to be kept informed of your valuable over all activities as every colleague knows the fact right from the beginning up till now. We are also aware that you are taking fup actions then and there instantly on common issues even in the absence of any complaints from members. Yes, you are bringing the specific complaints to the notice of higher-ups and pave the way for speedy favourable disposal. (Dns like CBE, Tinvly and MDU & Gentlemen like Sri. P.Ramanathan are indebted to you for the timely action taken ).
 
Being unable to move about freely as before due to the fracture, I am almost confined to my residence only. I could not extend my physical service to Sri. Angurajan in expanding our organisational strength outside Madurai Unit. But still I am passing on information about our court cases to some of our colleagues at Salem,CBE, Erode, Namakkal, Tinn'vly, Tuticorin, Kovilpatti, Nagercoil, Dindigul, both through e-mails and oral contacts thru my mobile and land line phone. Members of our Madurai Unit are well informed of our activities  ( be it towards legal front, mediclaim, legal fund, our official website, etc and the stead fast step-by-step developments )  thru periodical Executive & GB meetings.
 
My write-ups under General Category, Varistha Vaani,  Legal Battle Royale & ZZZ Comments and Feed Back of our AIRIEF Website must have passed through your kind observation. But fact remains that none could excel your ghost-like efforts. You must admit that my knowledge about internet is very very limited.

6)CONTRACTUAL OBLIGATIONS TOWARDS PENSIONERS   A lot of furore has emerged over the IBA's stand that there is no contractual obligations towards pensioners and such indignation is well justified. It doesn't require a tutorial for the IBA to prove that there is a legal contract between the public sector Banks and the pensioners. Following the Notification of the Pension Rules in 1995, employees/retirees were given an opportunity to decide whether they would like to be covered by the Pension Rules or not. This was an offer as far as the individual employees/retirees were concerned. Once an employee/retiree exercised the option in writing agreeing to all the conditions governing the Rules, an acceptance  was conveyed  to the employer. When the Bank  received the acceptance letter, the contract has come into being with the Banks having recorded his/her status as a pensioner. That is also proved by the fact pensions at the existing rates are being paid (although the quantum of monthly pensions is being disputed by pensioners on account of DR anomaly and lack of upgradation).
The same situation applies to LIC pensioners as well. The right of the pensioners to obtain upgradation on par with the wage increases for in-service employees is under adjudication before the Supreme Court under the three pending Civil Appeals.
If there is no contractual obligation towards pensioners, it has to logically follow that there is no contractual obligation towards serving employees as well considering that Supreme Court has equated pensioners with employees when it has ruled that pension is not a bounty or gratis but deferred wage for services rendered in employment, in its various judgments. Supreme Court in another case  has gone a step further to rule pension as property of the pensioner which means that ownership of the right to pension is absolute.
In the light of the above, any argument on the part of IBA that pension is not a contractual obligation smacks   nothing short of institutional irresponsibility.

7)Dear All,1)All over,a sudden brake on forward-thinking for Pension Upgradation, negative utterances,14th Finance Commission warning to UOI of a potential fiscal liability in future with the introduction of OROP for Defence Services etc resound & reverberate. We saw the  debacle for Bank pensioners when UFBU  backstabbed AIBRF& a storm of protest from all round,pensioners retorts with sound reasoning, the beautiful, sculpted, case laws quoted, the RECORD NOTE  , a virtual confession of retrograde developments for pensioners, blowing off utterly erroneous, highhanded comments---no contractual relationship exists etc with  a thundering REJOINDER from Retd GM, Bank of Baroda, the immediate clarion call of AIBRF ,the rally at such short notice with good attendance,what sort of UNITY  demonstrated ,hats off to Bank pensioners, AIBRF letters to  IBA, UOI &  sooner meeting to consider & resolve pensioners issues,that is what it ought to be.Hope & pray the Clock is wound  back for positive,open & frank dialogues
2)So, we should not lose sight of Main Objective of FULL DR to adversely affected groups of pensioners & Pension revision with every wage revision to be on TOP AGENDA without losing shine, Pensioners Fedns not to relax or relapse to an attitude of resignation but to persist in their progressive efforts & to intensify followup of measures they have chalked out earlier with full coordination with all Pensioner Fedns to be of one mind,
3)See the Attachments, 14th Finance Commission & Pension Expenditure & another Ministry of Personnel,Public Grievance & Pensions Dept& Pensioners Welfare,Office Memorandum on Revision of Pension of Pre-2006 pensioners.
Till such time, Pension Upgradation issue is resolved satisfactorily, words Pre & Post will remain & ALL Pensioners Fedns must ensure installing high the pedestal of Golden words of Magna Carta of pensioners ,famous Nakara 5 Judge immortal Judgement annulling heterogeneous division of pensioners who form a homogeneous group & so entitled for pension revision with every wage revision ,preferably ,as they said, on same lines as is normally done for employees for wage revision,
4)Read the 2nd attachment,right from CAT,New Delhi, to Delhi HC ,4 Writ petitions, All dismissed, then  4 SLPs  in Hon SC ,one pertaining to Central Govt  Pensioners Assn dismissed on 29/7/2013,,again harassment Review Curative Petitions ,also failed,GOI decided to comply by extending requisite benefits to parties involved in said SLP.
But SLPs36148--50/2013 were tagged on with CA 8875--76/2011
5)Look at 3rd  & 4th Attachment ,Page 1 & Page 2,
I pray 23 September 2015,date earmarked by Hon SC Bench Dipak Misra & Prafulla Pant disposes the LIC & UOI  SLPs tagged with CAs 8959--62/2013  in ditto similar fashion, as they are positioned in same manner, with greater authenticity on merits of the case,which will figure in Sr Counsels submissions, for which copious Notes,Data, Statistics,Pension bill a trickle 2.9 % of Total Mgt Expenses & Employee Remuneration & Welfare expenses ,Pension upgradation outlay not even the tail of the wage agreement,PLLI or Midday Meals Coupon, Basic pension static & unchanged for 22 years from 1/11/1993, unthinkable,Family pensioners jumping from 18% to 38 % & in some Zones 42 %,Pensioners above 70, pretty high Elders & Super Sr Citizens,Fundamental Rights violated, Rocklike LIC Board Resolution dt 24 /11/2001,so contractual obligations on lines of Hon SJ Bhandari, Jaipur HC extending the paltform of LIC Board Resn to subsequent wage revisions, by his Order dt 12/1/2010 admitting BOTH Writs of FULL DR & Pension upgradation 654/2007, confirmed by DB by dismissal of LIC Appeal & again yet another dismissal of LIC Review Petition, SC Bench then 8/8/2013 dismissing LIC SLP 29956/57 /2011. & in spite of hectic attempts on 30/9/2013 by Sr Counsel LIC to break the bottom & presuming case back to Square One, SC Bench clearcut NO STAY ORDER thus spoiling the wily designs of LIC/UOI,Chandigarh HC upholding principles of Jaipur verdict adding 12 % interest for delay & Delhi HC also tuning same verdict of Twin benefits in DB Jaipur Judgement, as many as 9 Judges of same mind,why even the NAMO dispensation ,not fair,ethical & equitable even to Sr Citizens & Elders,delaying & only now National Litigation Policy being spruced up,but IMPORTANT provision of earlier dispensation that Retiral benefits of Elders etc ,Instns/Govts shd not act as Compulsive Litigants ,delaying & dithering Final Outcome, this must figure,not mere administrative lacuna of bulging & expanding arrears by more appointments & filling vacancies, but a DEADLINE of 2 yrs or so,Elders must get reprieve.More so when Finance & Service Sectors are the engines of growth & not squander resources from Budget as CG.SG, Railways, Defence, PSE, Loss making PSEs with CG support etc,really All-New-Pension-Legitimate- World of ours , as against Monstrous Expenditure from Public taxes & Exchequer, right Royal we shd have secured.Further as reported 40,000 deaths of Bank pensioners & 15,000 deaths of LIC pensioners, who are answerable ?SC Bench must weigh these LEGITIMATE considerations & without any FURTHER adjournments, DECIDE insurance finale with a real APEX COURT spirit & courageous ,fair decision proving SUPREME ,bringing smiles on the faces of pensioners in the twilight of their lives

9) A few questions on Tele Talk with Chief (legal),CO
Referring to the useful report of Mr R B Kishore coming at a time of apparent information vacuum, I feel some enlightenment is required on the following points:
Chief (Legal) has informed that 20% out of the amount deposited earlier in Rajasthan HC will be paid to them.
Will the amount be paid only to the Jaipur petitioners or will the proposal be extended to Chandigarh petitioners  also?
Where do the Delhi HC petitioners stand where no payment has been deposited by LIC  in the HC Registry and where  significantly in rem benefits have been ordered by the HC  to be paid by LIC?
As regards the SLPs by UOI, the SC have ordered,"S.L.P.(C) No.....CC Nos.5437-5440/2015 Issue notice on the applications for condonation of delay, as also on the special leave petitions" So even though there is a near certainty that leave may be granted, Chief(Legal) was technically not  correct in  stating that SLP has been admitted. Whether leave is granted will be known only on 23/9/2015.So awaiting final outcome is irrelevant  to compliance with the interim order of SC.
Unless clarifications are available on the above points, we cannot be clear about the thinking of the legal dept  on LIC's  compliance with the SC's interim order dt 7/5/2015.

10)1)Both Chief Legal & Chief Personnel indicated that both Jaipur & CGH petitioners will be paid 20%
 
2)Chief P  mentioned that LIC has sought legal opinion as regards Delhi HC case.
 
3)We all see the happenings on OROP front,when all thought all is over satisfactorily.Pity is even after announcement Govt has set apart Rs8300cr,yet NAMO govt could not take decisive final step & we witness tomorrows protest
 
4)Here too in our case, LIC is cocksure any talk of pension revision can come ONLY after Final hearing on & after 23 September 2015.At present, other niceties, noone in LIC or UOI are bothered

11)Thank you for your elaboration. No doubt the finality can be expected only after 23/9/2015 when the SC hearing resumes.But how long the LIC can defy the judiciary is the question. The pension upgradation issue is so strong in our favour that if LIC fails to implement the interim order in the Supreme  Court in the right way ,the three sets of petitioners can concertedly launch contempt proceedings if only they want to  against LIC to force it to  obey the judiciary. But  such a proposition  seems to be wishful thinking.in the present circumstances. The OROP outlay is not comparable to that for LIC pensioners, but what needs to be recognised is that the outlay required is only for compensating for the amount denied to the pensioners. The SC can easily be convinced on that point. So we have to wait patiently for 23/9/2015.But aggressive management of the cases is the need of the hour including engagement of a  high profile senior counsel who will be duly taken note of by the Supreme Court.

12) Dear Sir  ,Re:MCJain case :I am aware that almost all of the lot coming  coming under this category are in their early 80s and it is not a viable idea for a section to go to Court and wait for its verdict which, in our experience, takes a decade or more. Just  I would like to know your valued opinion as a matter of academic interest. Nothing more. For sure, AIRIEF is seized of this matter also.

13) WHERE ARE THE RESULTS FOR M C JAIN CATEGORY OF RETIRED OFFICERS?
It is nice to read a very informative report from the General Secretary of the Class I Federation. It is nicer to note that " we work for results and not for publicity". But where are the results in the case of M C Jain category of retired Class I Officers about 80 of whom are still waiting to obtain the benefit of the Supreme Court judgment even though the SLP of LIC against the Jaipur Bench judgment was dismissed on 2/7/2014? The beneficiaries of the judgment are only a few retired Class I Officers. The Federation had collected Rs 1000/- each from a number of such retirees towards legal fund for fighting their case. They are yet to get justice. But ironically even Mr M C Jain did not receive the amount of arrears due to him except for a pittance of Rs 12000 plus paid to him by LIC in Feb 2015.
In this matter there are neither results nor publicity!

14)CAN LIC DISCRIMINATE?  Q.Sdsarma: Can LIC discriminate between petitioners and Pensioners being legal person and violate articles 14 and 19 of the Constitution? (Legal entity)
My opinion:
Constitutionally, LIC cannot discriminate. But when the petitioners do not constitute an entire group of similarly placed pensioners like an Association or Associations, the relief is normally awarded by the Court only in favour of those petitioners who filed the writ except in cases where the benefits are ordered to be paid in rem as happened in the Delhi HC judgment dt 30/1/2013. So when relief is provided only for the original petitioners in our cases, the only recourse available to the similarly placed pensioners is to join together and  file an application in the Supreme Court for directions to LIC to make payment to all eligible pensioners.
For this reason, I had suggested that AIRIEF should get impleaded in the Civil Appeals pending before the Supreme Court. Even now it is not too late.
I am sure that  legal experts involved in the cases apply their minds on the appropriate course of action.---------------------------------------C H Mahadevan
15)FRIENDS,   IT IS A HARD FACT THAT LIC MANAGEMENT INCLUDING THE CHAIRMAN, MD, EDs ALL ARE FULLY AWARE OF OUR RIGHT & LEGAL DEMANDS OF UP GRADATION OF PENSION AND REMOVAL OF DA ANOMALY, WHICH HAVE BEEN  UPHELD BY THE DIFFERENT HIGH COURTS AND ORDERED TO BE IMPLEMENTED BY WORTHY SUPREME COURT. 
 
THEN THE QUESTION ARISES AS TO WHY LIC IS HESITANT TO RELEASE OUR JUST DUES. BUT PLAYING TRUANT?  
 
THE ANSWER IS SIMPLE.  
 
THAT IS - THERE IS NO GREEN SIGNAL FROM THE GOVT OF INDIA/FM WHO  HAVE  
ALREADY FILED SLPs  IN SC,  AND NECESSARY NOTICES ARE BEING ISSUED TO THE PETITIONERS ALSO, AND 
LIC CHIEF(LEGAL) IS FULLY AWARE OF IT.
THEN WHAT FOR CLARIFICATIONS - MAY BE,  AS INSTRUCTED BY FM/GOI,  TO DELAY IMPLEMENTATION 
OF SC ORDERS IN LETTER AND SPIRIT I.
 
UNDER SUCH A SCENARIO/SITUATION WE PENSIONERS FEEL IT IS GOING TO TAKE MORE TIME IN DELIVERY OF JUSTICE, AND  WE ALL, WITHOUT LOOSING HEART, HAVE TO  CONTINUE THE LEGAL FIGHT BY EXTENDING FULL/ALL SUPPORT TO AIRIEF AND SH KML ASTHANA THE CRUSADER WHO GOT US THE HISTORIC JAIPUR JUDGEMENT ON WHICH THE JUDGMENTS OF P & H HIGH COURT AND DELHI HC ARE ALSO BASED, WITH ADDED ORDER OF 12% INTEREST BY P&H HC AND IN "REM" BY DELHI HC.
 
FRIENDS, WHEN THE FACTUAL FATE OF OUR CASE IS AS ABOVE ,  MANY VIEWS, NEWS, OPINIONS, PREDICTIONS, EXPECTATIONS BY MANY OF OUR MOST LEARNED FRIENDS AND LEADERS ON WHAT LIC IS EXPECTED TO DO ON SUPREME  COURTS ORDERS OF MAY 7TH, AND THE MEETINGS SOME OF THE EMPLOYEES ORGANISATIONS AND PENSIONERS ASSOCIATIONS HAD WITH LIC , THOUGH  EXHIBIT THEIR CONCERN ON PENSIONERS DEMANDS, BUT ARE MORE OF CONVICTION AND  SOME HAVE PREDICTED THAT LIC WILL SEEK CLARIFICATIONS ON SOME ISSUES AS IF THEY ARE PART OF THE LIC MANAGEMENT / OR AS IF LIC IS UNAWARE OF THEIR RESPONSIBILITIES. 
IT IS TIME TO WAIT AND WATCH WHAT ACTION LIC TAKES AND THEN MOVE ACCORDINGLY. NEED OF THE HOUR IS UNITY FOR THE COMMON CAUSE. ULTIMATELY TRUTH WILL TRIUMPH.

We do all know that Govt. of India is a big hurdle to allow Pension Updation. 
 
The Question however arises that we need to put all pressure on the Govt. of India as also
on the LIC by making physical protests too.
 
Unless we chalk out a multi-prong strategy including pressing to be a party to the
currently ongoing wage talks, we will not be in fact leading the pensioners community
toward the solutions of our issues as in the Charter of Demands.

     Sir, are you attending the Bhopal legal committee meeting  ? As you have stressed,  it is very crucial period for the AIRIEF. 
      Sir,  have you got the complete list of officers who have retired /died between 01/08/1992 to 31/03/1993 (Related to  M C JAIN case ). I had requested Sh Angurajan regarding this data but I have not received any reply  from him.
          One last request,  in spite of your age factor if you can come to Delhi before 23 September n discuss our pension case with the Sr Advocate , it will be boon for all pensioners.

"Financial involvement vis-a vis collection of legal fund, looks to be complex and in my opinion should be considered by the EC. Details of expenses incurred so far need to be explained to the members to re-inforce their confidence as some communications have created doubts in their mind. The legal fund collection campaign will be successful thereafter only.

20) Respected Sri Saxena,    I am happy that our esteemed senior Vice President, Sri R.B.Kishore has made an elaborate presentation of the prevailing scenario in regard to historic background,
the trajectory of our legal battle with the mighty financial giant, LIC, and the all-powerful
GOI/MOF, the financial burden borne so far by AIRIEF and the present status leading
to the ensuing FINAL HEARING on the 23rd September 2015.

We have to remember that we owe it to Sri KML asthana for identifying the issues of
DA/DR Anomaly & the need for UPGRADATION of PENSION to put an end to the
discrimination and taking up the battle initially all by himself. His painstaking efforts
and strategies have brought in significant results. We have to build on the strengths
achieved through him so far. It is quite understandable that certain recent developments 
have irked him and hurt him. But I am very sure that he will not allow these to dampen 
his spirits in his determined bid to take the issues to their logical end to benefit the
pensioner community !

It is also to be borne in mind that all further strategies will have to be planned only in
consultation with him and executed through him as he is the original PETITIONER and
now the PRINCIPAL RESPONDENT before the Supreme Court !

I am sure that our esteemed MEMBERS of the LEGAL COMMITTEE will take 
appropriate decisions, in the light of the above, to the supreme satisfaction of the
general Members who have been looking to this august BODY for expeditious and
effective guidance in the matter !
