Sir Obtaining information of Union Bank
(Employees') Pension Fund
Under your instruction, our Association had first requested the management of Union Bank of India to provide us information about the Employees' Pension Fund. But the management had denied the information on the plea that the particulars called for by us pertain to 'Commercial Confidence', etc.
Therefore, we had selected RTI route by filing four different RTI Applications to extract the information. Replies to all our RTI Applications as well as First Appeals were negative. Therefore, we had filed Second Appeals with the Central Information Commission, New Delhi.
For one of the four such Second Applications filed by us, a Notice was issued to the Bank as well as to us for hearing through Video Conference. A copy of the Notice is attached to this e-mail marked as File No.39. We participated in the Hearing on 7th July,'15.
While hearing took place, the Central Information Commissioner did not accept the arguments of the Bank that the information of the Pension Corpus was of 'Commercial Confidence'. The Central Information Commission pronounced his decision on the same day i.e. 7th July,'15 (and placed it on the web site) asking the Bank to provide us the required information latest by 15th August,'15. We had asked for information on 12 points. Out of which, information on Point No.3 & 4 were received by us earlier in response to a first appeal. Now the Bank has been directed by the Central Information Commissioner to provide us information on all the remaining points. A soft copy of the decision of CIC is sent with this e-mail as an Attachment No.49.
The entire matter (from the first phase of filing RTI application till the stage of hearing of the second appeal) was handled by us under expert guidance and help of one of the members of our Association - Shri J.P.Shah (stationed at Junagadh in Gujarat), who is considered a renowned RTI and Consumer Activist of our country.
The information, as and when made available to us by the Bank, will be forwarded to you as well as to the General Secretary of our All India Union Bank Retirees' Federation.
