disparity in the Basic Pensions prevailing between pre. and post 1-11-93 Pensioners
about which I had already written in my earlier post. Till the disparity is removed the anomaly will remain.
The thinking that getting the benefit of updation will automatically solve the DR
issue
faced by pre-Aug.97 Pensioners is a myth. This can be seen from the way
in which the interim relief just paid is calculated. As I
understand, the DR actually received on 1-8-97 was added to Basic
Pension and the total treated as revised Basic Pension on 1-8-97
-Dearness Relief on 1-8-97 being ZERO. The IR received by
some now is only on future accruals of DR. This method of calculation, I think, is a
fraud committed on aged Pensioners.
DR rectification for pre-Aug.97 Pensioners should be done
independentlly of updation. to bring maximum benefit. Discrimination in
DR arose from 1-8-97 with the
Goverenment Notification dt.22-6-2000 amending the pension rules prospectively
conferring 100% DR benefit to post-1-8-97 Pensioiners and denying same to pre-
1-8-97 ones. This discrimination in DR formula should first be removed from 1-8-97
by
again amending Appendix IV of Pension Rules applicable to pre-1-8-97
Pensioners and providing for DR @0.67% on full Basic Pension in respect
of
pre-1-11-93 Pensioners and @ 0.35% on full Pension for post-1-11-93 Pensioners.
When this is done, the DR amount on 1-8-97 which is zero according to LIC method,
will vary from Rs.255/- to Rs2334/- from AAO to ED. The increase in DR as on
1-8-2015 will be substantial varying from Rs.1777/- to Rs.10846/-.
I appeal to all our brother pensioners who are directly involved
in dealing with court matters to take what has been stated above into
their minds while finalising
their strategies for facing the SC Cases on 23-9-15.
