Sri S.R.Agarwal has raised pertinent
points & counters to the standard arguments adduced by GNS Fedn. Many
times, we in AIRIEF have argued impartially & neutrally, that with all
mammoth & colossal efforts taken by Sri KML Asthana & AIRIEF, loudly
& clearly proclaiming that when the whole world was sleeping, it was to the
credit of KMLA that he took up DR discrimination by writ 6676/1998 & after
LIC Board Resolution was born,24 Nov 2001, which also ,the Architect was AIRIEF
& none else,aftermath Wage charters were being negotiated & that was
propitious moment, when KMLA filed writ 654/2007
2)Wagging tails
of Full DR,AIIPA must have, then undertaken the assignment of securing for
pre-8/1997 pensioners then & there, when Discrimination arose & LIC
flouted MOU 12/1/1994 between Unions & LIC about same DR to pensioners as
same DA to employees, as a prelude to Pension Rules 1995.Why did they allow to
fester the wound & never did any iota of plan & strategy to strike the
iron while it is hot, the problem would have been over. It is to the credit of
AIIPA, when all is over, they want to become favourites to the victory as
though they did all to snatch success. No use trumpeting after the event
manager has already done a clean plan,execute the same. As if this is not
enough, they have an uncanny knack of sabotaging efforts, unified directions
movement by KMLA,AIRIEF when they sense fragrance, when they know ,judged by
any standards, Pensioners will host the
twin benefit Flag in full mast pull down efforts, it is a blot on fair face of
moral standards, which one has to preach & practice. They are past masters
in this drama .Fedn of Retd LIC Class I Officers Assns also could have
completed this assignment long long ago
on Full DR. They were also late travelers
but insisted on Single track dictum of DR ONLY
3)It is in this sense, when
3 HCs, enough Hon Judges of these HCs, directions from Hon SC ,NO STAY order, present
Interim Order dt 7May 2015 came, exaggerated importance being given to this as
though everything is over, when near 1300 Class I Officers, as submitted in the
List by Fedn, get 20 % IR payment to petitioners on so-called impugned HC judgment,
Jaipur.
4)I have to
report, I got a frantic call from our RIEA, Kozhikode, late evening, affiliated
to AIRIEF who also took dogged efforts to plan & win the Gratuity case with
sizeable help & inputs from AIRIEF, that GNS Fedn is wooing Class I Officers there, asking them
to give Membership Form filled, even backdating,& trying their best
to secure Legal Fund Donations. This is a brazen attempt to do anything &
everything thro backdoor, repulsive by any ethical standards.
I
am happy to learn members, when told about the events in holistic way, appreciate
AIRIEF stand & are desirous to expedite hearing without hitch & delay. I
was fortunate to visit this united, homogeneous group of Class I officers, KZE,
who function as a well-knit team, so well-organised , well-prepared little over
a year before, in a packed hall, intelligent doubts & queries lasted half an
hour, which I was delighted to reply to their hearts content.
KZE, Madurai,
Tirunelveli, Nil as per CO List, Vellore, Salem 1 each, Thanjavur 5, Kottayam
6,Chennai DO II ,7 ,Trissur 17, Ernakulum
31, Coimbatore 39,Chennai DO I ,45, ZO 65,Trivandrum 70,totalling 287.for
20% eligibility.
5) Else where, in a Blog, it
was mentioned , that this Fedn takes a deviant minority stand, collects Legal
Fund ,utilising this opportunity, & a fair estimate establishes total
collections to be a substantial one. Look at the pathos of event that out of
app 14,500 pre 8/1997 pensioners, such a microscopic number, less than 1300,
only gets interim 20% of wrong LIC calculations , many many in Class I
who are not members of GNS Fedn do not.
6)Fedn confirms that when
pension upgradation issue comes before SC, they will definitely support
it.
7)Pensioners, be aware of
these developments.SC Bench will hear the submissions in the CAs listed &
as Hon SC Bench stated in their 7th May 2015 Order, as it involves issue of
'enhancement of pension' ,& as copious materials with case laws &
latest Judgments on same subject ,embracing the twin benefits from all angles
circulated to you all,& AIRIEF talks with Sr Counsel at Delhi very positive
& productive, exhibit unity for total, holistic decision without being
tempted for a truncated erroneous conclusion.
