SHRI S.R.AGARWAL WRITES
I more than hundred percent
agree with the strategy and practical approach of AIRIEF and Sri KML
ASthana, as mentioned in the write up.In fact,I was disappointed with
the strategy adopted by Chandigarh Petitioners. They forget that
Chandigarh Judgement is based on the outcome of the litigation initiated
by Sri KML ASTHANA and they should take any step in consultation of Sri
Asthana and his counsels.
The crucial question is whether we want and
are satisfied with payment of 20% or our interest lies in having Jaipur
Judgement upheld by Hon Supreme Court. If at this crucial stage we
entangle ourselves and LIC on 20% issue, the main matter shall drag for
months and whether it will be in our interest, rather we will be walking
into the trap of LIC,as it wants to drag the matter as much as
possible,to tire us not only in our efforts but financially also.
In the
past also, some steps were taken by Chandigarh Petitioners, which,in my
opinion, were not commensurate with an unified approach to the main issue
of pension upgradation. In the mail of Sri Murthy on 23-09-2015, I did
not like the statement that Sr. Counsel Sri Nidhesh Gupta was no where
to be seen in S.C.,without ascertaining the strategy adopted by Jaipur
friends,as clarified in the write up of AIRIEF. We can not prevent any
body, but wisdom lies in the fact that such statements from time to time
gives the impression to the management about the division in the class
of retired employees, irrespective of cadre and the petitioners before
various High Courts.
The Need of hour is that management and UOI should
be confronted with a total and complete unified approach to the main
issue like a rock and conflicting and contrary views or statement should
immediately stop.
