Dear Sri Nerurkar,

I have recd your msg.I never meant pre August 1997 should permanently suffer .I hope you know  that I myself belong to that group of sufferers as I retired on 01-12-1995. I have seen circulars and Bulletin published by Class I Officers Association,Bombay, wherein interpretation taken of Board Resolution  and Jaipur Judgement was totally detrimental to the interest of retired class I officers also.When Sri KML ASTHANA took the fight to such an extent and won in all round of litigation till this date,what prevented our Federation to join hands with him all these years to ensure protection of interest of Class I Officers .You talk of cooperation from both sides.But my question is whether Sri Asthana should have taken care of  our interest or our Federation should have taken the initiative.In my opinion, when our Federation was all along taking the interpretation of board resolution and Jaipur judgement against our own interest relating to pension up gradation,such approach prevented it to join hands as a United front. If pension up gradation is upheld, D.A. Anomaly would have automatically vanished.I know that those who unfortunately left the world, can not be brought back to enjoy D. A. parity, which is still an interim order.You say  our Federation is not against pension upgradation, but pl tell me what steps were taken in that direction.I reiterate that the stand of  our Federation on Board resolution and Jaipur judgement strengthened  the hands of management and U.O.I.Pl introspect coolly and let me know the following....

If Jaipur judgement is ultimately upheld,which seems to me quite likely in view of various judgements circulated by Sri R .B .Kishore and other friends and other useful material on the subject,whether ClassI Officers Retirees will not be beneficiary.

God forbid,if battle is lost,which I do not foresee,what we were going to loose.We would have been in the same position as we are today.

In between these two situations,which option we should have preferred as a matured organisation.In my opinion, certainly the first.In other words, when Sri Asthana got first favourable judgement, our Federation should have come forward and joined hands, forgetting class distinction and who has to take the credit. I am of the opinion all retired employees are a class in itself, as far as question of retirement benefits is concerned.you say our Federation will support pension upgradation in S.C. I do not know how it will be done, when Delhi case is about only DA anomaly and Federation, to my knowledge, has not so far applied to imlplead itself in Jaipur and Chandigarh cases.

Further our Federation entangled itself in trap laid by LIC by furnishing list of its members.Delhi judgement was applicable in rem. In reply to LIC letter, our Federation should have thrown the ball in the court of LIC. in the interest of Class I Officers, who are not members of Federation.Its stand should have been that records are with LIC and it should implement for all Class I Officers.If necessary, matter should have been brought to the notice of Hon Court for direction to LIC not to indulge in dilatory tactics.

have left this world. We have succeeded in getting a decision
from SC for removal of discrimination. No doubt this benefit
should flow to all similarly placed class I officers and we shall raise
 this matter  before SC in the next hearing.
You are talking about co-operation but it should come from both sides.
When the Upgradation matter comes before SC our Federation will
definitely support it.

Thanks for your msg.But truly speaking, I am very much disappointed the way  our Federation has taken up this issue. In fact it has been toeing the stand taken by LIC AND UOI.Sri G .N .Sridharan is a very good friend of mine for long,but with respect , I totally disagree with the interpretation about the Board Resolution And Jaipur High Court Judgement taken by our Federation. I am totally in agreement with the way Sri K.M.L.ASTHANA AND ALL INDIA RETIRED  INSURANCE EMPLOYEES FEDERATION has been handling the issue.I am sorry to appreciate the efforts of the Class I Officers Association of which unfortunately I am a member. The need of hour is ,in the interest of all retired employees irrespective of cadre,that Class I Officers Federation should also support Sri KML ASTHANA AND AIRIEF before Hon. Supreme Court.We should forget the titles, we are all now retired employees fighting for common cause.In my opinion,  our Class I Officers Federation should have appreciated their efforts and supported them even with the funds in legal fight.

You may be knowing that our Federation had filed a case in Delhi HC
for removing discrimination in payment of DA.,which was revised after
01/08/1997. As per the recent Supreme Court order LIC has made
the payment of 20% DA arrears as interim relief. The payment you
have received is because of the efforts made by the Federation. The
balance 80% will also follow shortly.
 The Federation is in a need to augment its Legal Fund to face our
case in SC. I humbly request you to contribute at least 5% of the
amount towards this fund. The cheque may be drawn in  favour
of "LIC Of India Retired Class I Officers' Association, Mumbai and
send it to my address----6, Madhu Madhura, Prarthana S amaj Road,
Vile Parle (East), Mumbai--400057.

A sum of Rs 59,812 has been credited to my HDFC Bank Account today by LIC OF INDIA without any details or calculation.

I retired from LIC as Secretary,HPF,Central Office, on 01-12-1995.My pension is disbursed by Central Office, because I was settled at Navi Mumbai and recently shifted to Gurgaon,Haryana, due to old age to stay with my son,who was earlier a NRI.My S.R. Number is 207257 and Pension File Number is 277.It is just for information and necessary action in the matter.
