have seen your giving the number of retired employees from 1-1-86 to
31-7-97 as 16,498 in the Kozhikode blog. If we can get the number of
serving employees as at 1-8-97 or say as at 31-8-98 and as at the end of
the subsequent financial year end till the new rule of introducing
contributory pension, we may be able to supplement our arguments. As
against 16,498 retired, I feel that the in service employees as on
1-8-97 and subsequent dates will be more. LIC would have thought found
that it is viable to pay them more, in spite the pay revision then and
in the future also. If my presumption is correct, it will add strength
to our case.
I
have further developed arguments on Sec.48, supported by various
decisions, to the extent that the provisions of Sec.48 (2)(b) and (cc)
can be challenged as illegal. I am at it, but am waiting to get Shri
KMLA's version of the proceedings of 23/9, so that in the light of the
submissions of the SG, our further arguments can be supplemented for the
benefit of the Sr.Counsel. I firmly believe that we have a strong on
Sec.48 also as there is no doubt as regards the point on discrimination.
