1)i)Usually i do not amdavadis4everposts.but to day i read all the three posts.the post reservation – what about deprivation is thought provoking particularly a call to file a pil to make it mandatory to know the section of the population deprived whenever reservations are announced.the photos of queues in india are excellent also.----------AVSubbaraman
ii)Dear Sri AVS, amadavasi4ever gujarathi site is excellent actually, covering entire gamut of ones living.It gives ample tips on Health, lots on devotional matters, historical photos, Practical tips for living, refinement & enhancement of ones personality,updated info on incometax, savings & investment, class ,unique photos around the world,so beautiful, touching quotes & powerpoints on human & humane qualities thro pictorial presentations,in short, nothing is omitted. An academic, an intellectual, wanting to go & grow individuals,we retirees & elders get a lot of kick & all strata of society can benefit by browsing the insertions from this site.As it is etched, one is not able to remove that title name amadavasi4ever,so we need not be cold-shouldered about this site.

2)Reservation Vs Deprivation:
A matter of fact observation and a fit case for PIL since deprivation to even an individual is violative of Constitutional Provisions, except for ST &SC and that too for a limited period of 10/15 years, I don't exactly remember. Furthermore it is necessary to make public the list of beneficiaries with their present social and economic status and exclude such persons from availing reservation quota allocation, after fixing a reasonable criteria. This will enable the disadvantaged from the reserved class get the benefit who will also qualify for exclusion
Nobody seems to have asked one question i.e why do any one say that the so called forward castes, have cornered in the earlier days, all educational seats and posts in the employment sector. How many professional seats were available prior to say January 1950. What is the total number after that date. Assuming all the seats and posts earlier to 1/1950 was cornered for a period of 20 years earlier, what is the figure post that date allotted to the reserved section. Results may surprise all. 4)Thoughts on Dr AbdulKalam  Archana on the name of India:
I am really glad to read this piece. I am sure all of us, at the conclusion of Pooja/Prayer, at home/ temple/any place where any prayer is offered to Almighty , say "Sarve Janaa Sukhino Bhavanthu, Sarvathra Mangalani Santhu, Lokaah Samasthas Sukhino Bhavanthu," and in Tamil we say " Vaazhga, Valrga, Valam Peruga,Valamudan Vaazhga, Vaazhgave Vaiyaham". In all religions and in all Languages there is always a Prayer for UNIVERSAL WELLBEING. Be that as it may, it is Good of you to have highlighted the message of our former President .Dr. Abdul Kalam and his concern and thought was always about INDIA, our Mother land. 9) HARPING ON THE SAME STRING.
                From the circular of Federation of Retired LIC Class-I Officers Associations circular, I understand that the Counsel for the LIC seems to have stressed that Government approval was mandatory for implementing the direction of the Board. I was anticipating this arguments, when I made certain counter proposals. I was also expressing my opinion that more than this, LIC/Govt. may not have anything to argue. It has therefore become very important for us not to take this aspect lightly.
 
                It was, I thought, very important to break this stonewalling argument of the LIC, and I hope those concerned to whom I have mailed my arguments given in three or four instalments to review. In the last two  submissions, I attempted to imagine 10 questions that may be asked to our counsel by the Bench or may come as interjection from the Govt/LIC counsel. Through the answers to those 10 questions, I have shown that there are effective arguments supported by earlier SC decisions to break this stone wall built with assumed strength of Sec.48 of the LIC Act. I think my arguments require serious consideration, because my contentions on Sec.48 might result in very serious arguments, because I it is a novel challenge. Our captains should have a serious discussion on the points with the Senior Counsels and may require to be strengthened further with their expertise and knowledge.
 
            In my submissions under the heading 'A REVIEW OF SEC.48 OF THE LIC ACT, 1956" , I have shown the Sec.48 provisions as without teeth and opened the concept of hidden powers, that I believe answers all questions. Though I am not repeating all of those points for the sake of brevity and confidentiality, I am sure, those leaders conducting the case, whom I know personally, to once again review and be ready with written arguments on those points. Let us not miss any points. I firmly believe we have a strong case to win. The result will have far reaching implications for those in service employees also.

10)Dear Mr Ramanathan,  I appreciate and admire your erudition and optimism.No doubt you are bringing your legal knowledge and experience into full play through your legal inputs,but to what extent it is taken advantage of  and utilized in the court room will determine the degree of success in the ongoing CAs. 
Having said that I wish to leave with you my thought on a point which in my view has a crucial bearing in the case especially the CA against the Jaipur judgment.
I feel we need to decide whether our objective is to have  the Sec 48 struck down by the Supreme Court or to effectively lay a ground through our counsel's arguments to ensure a direction by the Bench to the GOI to use its powers  under Sec 48 so that the violations of Articles 14,16 & 21 of the Constitution are rectified by amending the LIC Pension Rules, 1995 thereby removing the discriminatory treatment of pensioners based on different dates of retirement.To me the latter course holds more promise of striking a favorable chord in the minds of the Bench.
 
In my view our case has got enormous strength on merits due to anomalies and disparities.There is also human rights angle.There were 21762 pre- August 1997 retirees as on 1/8 2003.The number dwindled to 16498 on 20/2/2009 due to deaths of over 5000 pensioners in this category over 5 years.Now another 6 years have passed by with higher mortality due to advanced ages. According to the faulty formula followed by LIC,family pensioners of the deceased pre- Aug 1997 retirees will have recoveries instead of increase in pension.We have already discovered that retirees from the cadres of RCs and below are left with declined pension according to LIC method.With so many anomalies in LIC's approach,it is more important to highlight these deficiencies in the LIC Pension Rules as they  exist today before the Apex Court. I am sure you will  be able to apply your mind as to how to dovetail the above facts with points of law to our advantage and provide your inputs to Mr K M L Asthana suitably.
 
In the over-riding focus on pre-August 1997 retirees in the context of 20% Interim Relief,the issue of up gradation of pension and also the interest of post- August 1997 retirees seem to have been relegated to a secondary position.This issue  also needs to be propped up on sound legal arguments.
