Food For Thought.-Response II

Dear Sir,
You have very rightly assessed the prevailing situations and the present day apathetic approach of the bureaucrats as well as the politicians who are in the helm of authority and are supposed to be responsible to secure a social order for the promotion of welfare of the people. The equity demands that what principles you apply for your self, the same you ought to apply for others. LIC pensioners’ legal cases for DR Anomaly resolution and pension upgradation with each wage revision have been testified on judicial scrutiny but it is probably the bureaucratic arrogance which has dragged us to the Supreme Court. It is a well-known fact that board resolution dated 24.11.2001 was for resolving the DR anomaly by revising pension with each wage revision of in service employees. There were not only exchange of letters between LIC and Finance Ministry on the matter of pension revision with each wage revision but several rounds of talks between the officials of Personnel Department of LIC Central Office and Finance Ministry had also taken place where LIC had submitted its financial  report duly verified by Actuary. Today, when we see how LIC Management has twisted and misconstrued the said board resolution while depositing the money due to the petitioners, we are shocked and fail to understand as to what has happened to the values and culture of LIC of India, whom we have established as a symbol of trust & belief.
I am also surprised when some of the legal experts, who are of late very active and vocal for the cause of pensioners see the grounds of favorable judgment of Jaipur HC as Achilles Heel in the Supreme Court. LIC has made out its appeal in the Supreme Court on a weak law point of applicability of Sec 48 of LIC Act 1956 and by twisting the spirit of the board resolution. All the points stated in the post of said law expert have been taken therefrom. Shri KML Asthana and AIRIEF leaders have taken all these points into consideration and prepared our defense properly so I am not worried of said Acilles Heel; but I am really worried for the unethical ‘uru-bhangam’ approach of LIC and its supporters. I am aware and confident that our leaders and the Sr Advocate are fully prepared to safe guard pensioners’ interest and counter the arguments of LIC /UOI and will come with final victory in the Supreme Court.
