Referring to the post of Mr SN,my view is the SC judgment on up
gradation will have no bearing on pensioners similarly placed as Mr
Vijaya Prasad among post - August 2012 retirees unless there is an
incidental order to amend the pension rules to reckon pension on the
revised scales of pay.For pre- August 2012 retirees in a similar
position, up gradation will only result in revision corresponding to the
pension fixed on average emoluments after retirement.
A separate amendment for removal of the anomaly arising for the likes of Mr Vijaya Prasad has to be bargained for by the in- service unions.
