Dear Shri Asthanaji

Sub: Order on MERITS

I pray for your good health and hope that Godmay bless you to complete the judicial process, thoughcumbersome, win the cases successfully as you haveinitiated, continued and won so far inspite of your ill health and hurdles made by some now and then we have survived the destiny so far and borne the delay and cost caused by numerous  adjournments indulgedin by the courts .The emotional outbursts made by many now may be due to their heart burning issues at their advanced ages and expenses caused byhospitalization in  their lives .Nobody can deny the sincerity and filial duty of a son to his hospitalized father. Your frustration is natural but I request you to kindly not to be disheartened  until we succeed in our cases. But, out of court settlement is unthinkable at this stage but our cases may be adjudicated on  "Merits and Mercy" by the Supreme Court.

By invalidating the NJACACT 2014 on 16.10.2015 , the five judge constitution "Bench headed by justice J.S KHEHAR has held on the their order of merits that the primacy and independence are the main concerns of the judiciary and stated that in a situation where the government  is a major litigant ,and when the commission is packed with the majority from the executive side ,the  appointment of judges to the higher courts would breed a culture of reciprocity of favours between the government and judiciary and this would prove disastrous to the independence of judiciary. Inours too, without the NJAC Act being in force ,theGovernment and LIC of India have imported a senior law officer of the law ministry, Solicitor General to argue their case in Supreme Court to influence thejudiciary and seek more adjournments at a stroke. Inthis connection another senior- most law officer of theGovernment, Attorney General has argued on 23.06.2014 that the arguments of  Advocates in thecourts are  superfluouwhen both sides have already filed their affidavit and the counters in the courts so as to minimize the pendency of the cases in the Highercourts. Who are there to heed these advices?

The seniors are being harassed both physically financially in the evening of their lives by the judiciary and bureaucracy by their ill conceived procedures. Maywe hope for the best on 20.01.2016?

With Kind Regards

TuticorinYoursfaithfully,
