Proceedings of SC 2-12-2015

Dear Friends,

Appended  herewith is the write up of our President Shri Saxena on the captioned subject.

We are writing what is pertinent only.

GK 4-12-2015

PROCEEDINGS IN SUPREME COURT ON 2ND DECEMBER 2015

The case was to be heard by Justice Dipak Misra & P C Pant in Court No. 4. It was numbered as 103, to be taken up after 7 misc cases. It was expected to be taken up around 1 PM or after lunch.
//   In the morning there was a message from Mr. Nidhesh Gupta that his father was hospitalized and was to be operated upon at 2 PM on 2nd Dec' 15.
//   Shri Gupta therefore sent the message to all concerned Advocates that he was going to mention to the Judges that in view of illness of his father, the case may be advanced  i.e. may be heard at 11 AM. As soon as both the judges entered the court, Shri Nidhesh Gupta made a request to the judges accordingly but Justice Misra told that the case would be taken up as per order or else it will be adjourned. Accordingly, it was adjourned and the next date is 20-Jan-2016.
//   Earlier, Shri R K Singh, our Advocate met Shri M Sreenivasa Murty and apprised about this.  Shri M S Murty said "Ok, even otherwise the case was not likely to be heard". Incidentally both Saxena (President) and Mr. Pramod Bhatnagar  (Joint Secretary) were present when this interaction took place in the corridor of the Supreme Court. M/s K M L Asthana& Trilochan Singh from Jaipur and B S Verma from Meerut had come to attend the proceedings and were present in Court Room along with SSS and PB.
//   Shri D D Gupta of Delhi could not arrive due to local constraints. It will be pertinent to explain a situation which has been taking the rounds quite often.

If it is reported by some people that on a particular date our Advocate was absent, our members feel that the case is not being handled carefully. This is to demotivate and demoralise our members, though it is not correct.
//   Sr. Advocate is paid on the basis of appearances he makes for our case. If the case is not likely to come up, we do not request him to come to court and we are not required to pay his fee. This step is taken in order to save money which our pensioners are contributing. Our members can understand the situation well.
//   We have been in regular touch with our Advocate and Sr. Advocate. The leadership is doing its best to take care of the case and the fund management.

In case of doubt, members are requested not to hesitate to talk to the President or the General Secretary.
SS SAXENA

PRESIDENT,
