SC judgment in Deokinandan Prasad vs State of Bihar

I reproduce the  operative part of the judgment:


"Having due regard to the above decisions, we are of the opinion that the right of the petitioner to receive pension is property under Art. 3 1 (1) and by a mere executive order the State had no power to withhold the same. Similarly, the said claim is also property under Art. 19(1)(f) and it is not saved by sub-article (5) of Art. 19. Therefore, it follows that the order dated June 12, 1968 denying the petitioner right to receive pension affects the fundamental right of the petitioner under Arts. 19(1)(f) and 31(1) of the Constitution, and as such the writ petition under Art. 32 is maintainable."

Scrapping NPS to remove future anomaly


Referring to the post of Mr P K Bhatt, the pension disparity  that will arise  when majority of existing employees are covered under the New Pension Scheme cannot be helped as the NPS and the Pension Scheme for pre April 2010 recruits are  two different pension  schemes. So there is no question of anomalies as the shemes are not legally comparable. Present old pensioners are too concerned with justice for themselves to think of this 'anomaly' that  may arise long after their exit from this world.
The in-service employees' Associations/Federations are powerful enough to negotiate with the LIC/Government for scrapping  the NPS which the helpless pensioners cannot do even if they wish to.

as  ZO OS authorities from RMOS, Sy OS to AO OS & others,the EXCESS 

MEDICLAIM PREMIUM PAID FOR 2015-16 is being  CREDITED/PAID 

ALONGWITH  PENSION DUE MAY 2015 to be credited on Monday 1st June 2015

2)Please enrol 3or 4 new members for RIEA CHENNAI &inform me of their Full particulars ,name, cadre, month/year of retirement, complete address, mobile no,email id & any other useful data

3)U must have recd yesterday a copy of my email as a fup of my talk with EDP,LIC CO to regularise TPA, MAKE CLAIM FORMS SIMPLE, RETAIN EXISTING ONES, ECARD oF TPA to be downloaded quickly after they confirm all info keyed in etc, website & email id of TPA etc

4)Whatever u can donate, please donate for Legal Fund, as good collections were nearly exhausted due  to few sittings in SC Bench where our Sr Counsel had to be present & made submissions.U must also have seen the stepmotherly treatment meted out to Bank pensioners, when not a single demand of theirs was discussed or resolved & a shameful RECORD NOTE  was circulated by UFBU, fully detrimental to retirees interests.We circulated  the Point by Point Rejoinder by Sri Ramachandran ,BOB Retd GM in a befitting manner & my observations too,LIC/UOI is looking at pensioners with disdain.U also might have viewed in all English News Channels 7 others too the feverisg, frenetic ,angry utterances of many participants on OROP which still, tho stated to have reached finals,Army officals decided to biycott all functions till amount is credited to their bank account
Such is the anger everywhere.We cant take things lying down.It is possible LIC again at the behest of UOI/MOF may pay 20% of dues to Jaipur Petitioners  before 18 june 2015 confining to ONLY DR.So that will invite Contempt as 7th May 2015 SC Bench order says 20% of impugned Court Order--meaning the Jaipur  DB judgement,which of course, as u all know admitted BOTH writs on FULL DR & Pension upgradation as was clearly delineated by Hon SJ Bhandari Jaipur HC
So, again a critical situation has arisen, as LIC is driven to a corner, trying to extricate from SC clutches but awaiting Final DDay ON 23 sep 2015.Mark the words of SC Bench Hon Judges 7th May, as it involves issue of ENHANCEMENT OF PENSION, POST the Case No 1--5 as PRIORITY.It is tragic that even the APEX Court wants to drag on & even allowing UOI backdoor entry after 5 years !!We described vividly & delineated exhaustively from ALL ANGLES,legal, constitutional, past many case laws, recent valid judgements, financial, Fundamental Rights violation, 15000 Pensioners have died, FP rose to 38 % of RP,LIC Board Resn dt 24Nov 2001 is a Springboard for further extension to subsequent Wage periods as Hon Bhandari pointed out monstrous anamolies of 8 cadres below getting more pension,recent Court cases, emphatically  lays down Same Cadre, Same LENGTH OF SERVICE to RECEIVE SAME PENSION & signal dedicated contribution by pensioners to make LIC lustrous,LIC financial solvency & stability unquestionable,Mere 2.9 % is spent for Pension Bill out of Total Mgt Expenses & Employee welfare, what more needed, Govt FP is more than LIC RP, Wa,yet we have to wait & wait.  Let us display full unity,mad rush to conclude 7th May verdict as DR only a retrograde utterance, have more endurance & equanimity ,knowing judicial wheels move so slow & rickety & dictatorial single track mind of MOF/UOI we have to thwart only thro SC & SC alone

R B KISHORE WRITES TO ED(Personnel) Re:Pending problem of Pensioners

 Dear Sri Niraj Agarwal,        Pending Problems of Pensioners   
       
                This has reference to my teletalk with you a few days back.

1)       We appreciate LIC’s forward thinking in crystallising Family Floater Policy wef 1/7/2014 ,which we pensioners had demanded & included in Charter of Demands Booklet ,24 pages,titled Our Expectations : Health, Happiness & Harmony, presented to Chairman, MD, ED(Per), Chief P & Secretary P  in November ,2012.

 i)       While thanking LIC for  universal Cashless Service introduced & also marginal 10% reduction in mediclaim  premium,I pointed out that Refund of excess premium paid has still not taken place.the Programme for premium refund for Employees came to ZO 10/12 days before but still Programme for refund for Pensioners ,in spite of vigorous followup has not reached ZO/Dos.It will be anamolous that Employees get refund alongwith Salary on Monday 1st June 2015,while Pensioners may not. Please expedite.In fact ,we prepared the Mediclaim Refund Ready Reckoner immediately after CO Circular was received & circulated to our members by 20thApril,2015

ii)        While on this, I made a fervent request to you ,that for some valid reasons, Pensioners, aged as they are , many go abroad to be with their siblings for few months, sometimes LIC Pension disbursing Office letters are not received,Family Pensioners many are even ignorant  of salient provisions,some are indeed too old & none to help,pathetic indeed, & so what for years & years we have been  sincerely & seriously insisting,which CO Personnel Dept orally realized the truth of the statement that ,as in the case of Employees ,mediclaim premium deductions can take place every month from Pension amount.
            SZO has standard practice for years ,that of deduction from pension amount in 3 months, all over by Dec/Jan/Feb so that on 1/3 Full deductions are over.All along it has gone on well, accounting done pucca. 
            What prevents LIC CO not to take a positive & empathetic decision, we do not know.I PLEAD with your goodself to finalise solution to this real issue once for all, so that as of now, when some pensioners go out of the Scheme, valuable risk cover is lost & such things cannot happen,when this procedure is finalized.SCZ does it in 2 instalments,Other Zones we are not aware.We shall be highly obliged if it can be made uniform .deduction in 4 instalments, as in many cases, because of low pension, Net Pension will be too low after such deductions.

iii)         This leads to the corollary of LIC extending help to all for a One Time Option for reinduction. More so,after FFPolicy & introduction of Cashless facility for hospitalization, there is a dire need for pensioners to get back to the FFPolicy & with deductions of mediclaim premium in 4 instalments,  the Optional Sum Assured chosen will be protected. We shall be eternally  grateful to you for this kind act of yours,which we eagerly await with optimism.

iv)a)      I  brought to your notice that  TPAs devise their Claim Forms which are complicated,very detailed with micro particulars as against LIC Mediclaim Insurance Policy Claim Form, 1 page, so simple, so easy to fill up & complete, & all along for years & decades stood the test of time, Why should TPA impose themselves on  LIC instead of LIC democratically imposing on TPA for judicious use, employees & pensioners must be at ease to fulfil conditions with due respect but not such a complicated Form ,2 long Pages,our LIC Form with 12 details required,present Format by TPA divided into many Sections with 73 details , Part A with 39, Part B 34.Many columns are complicated to answer. Everything appears to be in favour  of TPA.It is likely that claims will be delayed or sanction reduced substantially.This TPA is MD India Health Services & earmarked for NZ,WZ, CO & CZ.They can cause havoc.PLEASE SEE that TPAs shall not introduce claim format UNILATERALLY.

b)          Claim Form Part B to be filled by the Hospital also is so detailed, runs into 2 Pages.All along, here too,LIC Form for Hospital was simple,relevant to the core, contained all vital data.
EVEN.Guidance for filling Claim Form  Part A by insured is a full 1 page,
So too,Guidance for filling Claim Form –Part B ,to be filled by the Hospital is itself 1 page
Your Dept will have all sets of Claim Forms.
              I may stress that before it is too late,in the interests of employees & pensioners,Uniform Claim Form Part A for insured & Uniform Claim Form Part B for Hospital & preferably the Existing ones, to which all of us are accustomed must continue & TPAs duly informed to follow & implement the same.

v)           After a useful & productive meeting with then Chairman Sri D.K.Mehrotra for 45 minutes  in  Conference Hall,Yogakshema,CO Circulars affecting employees & pensioners & related issues,such CO circulars are being flashed by email immediately to the Assn Representatives. Sri Sanjay Gupta ,AO Personnel was adhering to this meticulously.

vi)          I  portrayed the picture of non-availability of Data on pensioners on an All India basis,a sad position.Actually all ZOs consolidate & send to CO various Statements.We want All India Regular Pensioners, Family Pensioners, Exgratia Retirees Zonewise/Division wise  with Totals & for CO. We got such a Statement as on 31/8/2013,that too Excluding CZ.

              Please help us with All India data of RP,FP,ExGratia Retirees as at 31/3/2014,30/9/2014 & if possible 31/3/2015.In fact ZO s send consolidated Pensioners Statement Pension Payment wise,ECS  & other modes & totals which must tally with total numbers.Also, as SZO has already sent 31/3/2015 Pensioners Valuation Statement  by 15th April 2015 itself, other ZOs also must have complied with provisions.Please treat this as a humble request & request them to send to my email id  rbkseetha @ yahoo.com & rbkseetha@gmail.com  , as sometimes Yahoo creates problems.

Who ever said there is no contractual relationship between Banks/LIC and pensioners? The Meriam –Webster Dictionary gives the meaning of  the word 'contract'(verb) as “shrink, lessen esp. to draw together esp.so as to shorten”.
True to this meaning, with every wage revision, the salaries of employees expand and the pension in relation to them contract! Forget that the policy document is an evidence of an insurance contract and the Pension Rules  1995 are an evidence of the  Pension contract!
The IBA could very well have conceded that there is a contractual relationship between the Banks and Pensioners within this dictionary meaning of the word ”contract” instead of labouring hard to deny such a relationship. There would then  have  been no legal hassles for them in future.

OBSERVATIONS & A LESSON TO LEARN BY LIC FOR EFFECTING IMPROVEMENT IN SERVIVING CLAIMS:



1)Though in the 10th Bipartite Wage Settlement for Banks with IBA ,Group Medi claim policy details in full are enumerated from Page 33 –56.
While the 32 pages, as is customary,are exhaustive  presentations in several Paras & Clauses & Subclauses,I concentrate on last 3 pages ,Page 54,55 & 56 as above[ FOR THIS SEE EARLIER POST:Ed.]
For convenience, I have highlighted in different colours, to lay emphasis,to easily grasp the fundamentals,& to understand & appreciate the Rules & Procedures laid down, to enable us to compare with LIC Group MediClaim practices & under Select items to enhance & improve our practices.This does not, in any way,compromises the FFPolicy conditions & privileges but only salutary mechanisms Banks are endeavouring to install to make lives happier for all employees ,for medical treatment & hospitalization & to reap the fruits of the negotiations without hassles or any murmur.
2)Para 1 ,c)itself commences with a positive empathetic note, ‘the collection of data of dependent family members at the initial stage may take long time. In such cases claims pertaining to dependent family members of employees pending collection of data may be settled on certification and recommendation of the appropriate authority of the respective bank.
3)Para 6 mentions about allocation & use of Corporate buffer & nicely portrays “The unutilized Corporate Buffer of the member banks would now be proportionately available to the member banks whose Corporate Buffer has been totally utilized. This would be one of the major benefits of the Group underwriting of all the member banks under one policy and at the same time individual underwriting of each member banks for data processing, servicing and claims.”—heartening to the Banks
4)Paras 8 & 9 are crucial,well laid down, pinpoints TPA role correctly & forcefully.In LIC ,TPA so far is invisible.For the fabulous premium LIC pays to New India,this role of TPA must be insisted upon.RBI Chief GM, HRD holds regular sessions of pensioners with TPA & jointly discuss problems ,issues & grievances & so are more prone & sensitive to urges & demands.Obviously, solutions also are reached quickly
LIC must aim to have same identical role for TPA “The Third Party Administrator, appointed by the lead insure viz United India Insurance Co. Ltd. will station their representative at the banks regional/ nodal offices from where these banks have been settling medical claims of their employees.

The Third Party Administrator, would have a Dedicated Office, Server and a 24 X 7 Call Centre for the Member Banks of the Indian Banks’ Association.
5)Paras 10 & 11 must be the be-all & end-all for LIC to draw polite attention of our TPAs & ensure right now such full participation of TPAs in daylight presence to empathise & fully cooperate with LIC Offices to settle claims, which takes unduly long time.If one reads these paras,one can realize how much behind we are & how LIC hesitates to book TPAs & command them to enhance efficiency to help ailingpersons to, afterall, get their claims settled vey expeditiously
6)Read “The employees would submit the claims to the same regional / nodal offices where they have been submitting in the past and the Third Party Administrator representative will be the backup support and ensure claim settlement is completed in thirty minutes.

(The Third Party Administrator should ensure placement of representative in all the regional/nodal offices of the member banks where the employees have been submitting their claims in the past)
What more is required,if this aim is fulfilled,that will be a great day for such real good practice to percolate to all TPAs & fulfilling abundantly the CORE PROBLEM for all coming under Mediclaim scheme
7)Para 12 is exemplary,as without rhyme or reason,rejections taking place ,can be avoided.It is gratifying that IBA & Bank Unions have virtually installed a built-in Ombudsman.
No claims would be rejected by the insurance company/ Third Party Administrator unless the same is rejected by the committee comprising of the Bank management, Insurance Company, Third Party Administrator and K. M. Dastur Reinsurance Brokers Pvt Ltd.

8)Para 13 is a polite reminder to LIC to put in place a mechanism for Cashless Service ,with full cooperation of TPA & Hospital authorities.How much time it is taking, even to get an Ecard from TPA.Golden hour palpitation troubles our mind, family is disturbed,no proper velvet guidance to smoothen matters.But here “In case the employee or his family member gets admitted in any of the preferred Provider Network of hospitals on production of ID card, the hospital authority in turn shall notify by fax / mail the details of hospitalisation along with ID card number and Name of the employee to the Third Party Administrator, who would again revert by fax / mail a confirmation to the hospital to proceed with the claim. This would even enable them to claim from anywhere in India and they would be able to admit themselves in hospitals anywhere in India by merely calling the dedicated call centres of the Third Party Administrator, which would be working on a 24x7 basis. The Third Party Administrator, would even be able to advise the employees on the nearest hospital available in their area. In case of an emergency admission to a hospital which is not in PP Network, the employees also have a benefit to get himself admitted on a cashless basis by intimating the Third Party Administrator, call centre number, mentioning his ID card No and name. The hospital authority would fax / mail the details of hospitalisation to the Third Party Administrator, who would again revert by fax / mail a confirmation to the hospital to proceed with the claim. ”
 Here, all the nuances & variable circumstances which can arise in such Emergency situations, have been ably thought of, discussed & codified for the benfit of all parties for a complete understanding of this Vital & important issue ,for Cashless service.We pray LIC rises to the occasion & installs a hassle-free procedure without any detriment to the insured.
9)In LIC, neither Employees nor Pensioners have availed cashless service,is the talk of the town.That situation must disappear, all because Cashless Facility to be availed must contain such roots& essence  inscribed in Bank deal with TPA skillfully
This is echoed brightly in their Para 14,  Most of the claims would be cashless; which would be paid directly to the hospital concerned. ”
It is LIC’s duty to get transformed to make this a reality.
10)Para 16 is another eye-opener.Read : “Wherever the hospitals are not in the approved list of Third Party Administrator, the Third Party Administrator should take necessary action for addition of those hospitals on their network hospital list in consultation with bank. In an emergency the claim payment would be paid to the hospital account and empanelment of the hospital would be considered.”
What more is required,so liberal, maximum empathy & consideration ,indeed needs emulation & practice in LIC too
11)Para 17 also demonstrates flexibility “All the addition and deletion of the employees and dependents of the various member banks would be done on a monthly basis. A newly recruited employee would automatically be admitted in the medical scheme from the date of his appointment letter “
12)Para 18 hits the bulls eye as it pertains to Id Card.We are clamouring ever since LIC CO circular of 31 March 2015 & 14 April, 2015.
We appeal & entreat to LIC to implement such salutary & liberal practices ,without any further delay.
“ID cards will be prepared within 10 working days from the date of receipt of data. These cards can be couriered to the respective branch office in which the employee is located. The cards can be distributed by at the branch office by the bank’s branch manager / any other person who is made responsible for the same. Corrections in cards, if any can be e-mailed to an exclusive id which will be exclusive for cards correction errors. This cards will be corrected and resent within 2 working days from the receipt of correction mail.

Please go through & help the insured to experience  contentment & happiness,even when dire need forces him for hospitalization by making considerable improvements right from now on, to educate & enforce discipline amongst TPAs.Please also implement various provisions so correctly incorporated in Bank mediclaim agreement & certainly LIC must outwit banks with a democratic practice & calling us representatives alongwith TPAs to sort out issues & problems for a happy tomorrow

          Letter addressed by Ramachandran on note by I.B.A and U.F.B.U ON           RETIRED BANK EMPLOYEES ISSUE
The  Letter addressed to Secretary,DFS by Sri Ramachandran,cogent & cohesive,a fitting point by point rejoinder substantiated by case laws & accepted principles & procedures well-known,clearly enunciated & forcefully reminded to restore sanity & in that process wonderfully blows off the lid  that wilful,erroneous,hand-in-glove so-called  Record Note signed by UFBU & IBA,so illegal & unconstitutional,a blatant violation of Pensioners Rights & a cool hands-off attitude of IBA towards pensioners , with connivance of UFBU.

It looks this RECORD NOTE,instead of attempts to subjugate Pensioners has already aroused their sincere feelings, & hyper-critical remarks against retirees  rightful, modest & legitimate demands wanting to be once for all suppressed, shall certainly backfire against Managements & IBA .

This unique Landmark Record Note will go down in history as a Record Note of sorts,anti-labour,anti-Elders & anti-Sr Citizens,anti-Human Rights & above all brings to the surface the simmering one-sided Employee -oriented wage talks to the utter detriment of all pensioners & oozing in contents with absolute negativity, not even exhibiting an iota of concern to pensioners,or any sense of HRD  or empathy towards a dwindling species,totally forgetting the dedication & sacrifice by these Elders to the cause & progress of the institution they served .
