Rajrao12: While reading Ramakrishnan Sir's note I was just wondering about one thing. 
Is it not that the pension liability a part of Management expenses.? 
However if it is, then it need not come from Valuation surplus but has to come from Corporation's Operating surplus. 
Please correct me if I am wrong.

Dear Mr Sahni
Where was the need for you to apologise for kindling unnecessary hopes in the minds of pensioners? You have judiciously published both the charts - the correct one as per SC order which is the legitimate amount receivable and the incorrect one as per LIC's own machinations to deny what is our dues. Thereby you have done a yeoman service to expose LIC's hostility towards pensioners and to what extent we stand to lose for no fault of ours except to have served this mighty institution with loyalty and devotion. Continue your good job of educating and enlightening us with more information and enchanting/soothing youtube videos such as " Birds in Flight".

cumar_cumar: Mr A A Rawani can refer to CO Circular Per/ER/A No ZD/1171/ASP/2010 dated 9-12-2010 for knowing the method of arriving at 10 months avg pay in cases of his type where part of the 10 months period falls under old scales and other part under new scales. Para 3* of the circular explains the method. 
Whenever the instructions for refixation of pension due to revision of scales w.e.f. 1-8-2012 are issued by CO similar explanation will obviously be there and Mr Rawani need not worry.

                          First of all, let me introduce myself . Sir, I am ABDUL AZIZ RAWANI, resident of RAIPUR ( CHHATTISGARH). I retired from STC, LIC, Raipur  as a Faculty member in the Cadre of DM.  I know you as  PENSIONER's VOICE and SOUND TRACK Editor. I got your E-mail id from this Forum only.

                         I have been  regularly visiting your above FORUM since last few days and I appreciate your Devotion  , Promptness , Accuracy and Way of Presenting in the FORUM  and your  involvement and Hard Labour for nice Editing. I am particularly impressed with your "Pension Anomaly Chart as on  31/01/2016 Post Wage Revision in LIC ", prepared in Excel Sheet . Sahniji, you are doing a very Good Job for the Benefit of Our Retired community, for which you deserve due appreciation from all of us.  

                        Dear Sahniji, please don't mind, I am giving you some trouble. I am confident that  you are the proper person to guide me for correct way of Calculating and arriving at my Basic Pension. In fact, there is a matter of  interpretation of Pension Rules involved in it, which, as an Expert in dealing such matters, you  must be able to interpret. Moreover, it will give rise to huge financial loss, if not interpreted properly by the concerned official, while fixing Basic Pension of a person falling under such a Group like mine. In fact, till now, no Arrears have been paid in our Division to any Post 01/08/2012 Retirees and as informed  by Divisional   Office,they have referred to Zonal Office. 

                Sahni   Sir,   As per Pension rules, Last 10 Months Average Pay has to be calculated. I retired on 31/01/2013. As such, I have to take into account my Basic pay and FPA from April 2012 to January 2013.

                              Here, I may add that my Basic in the DM's Cadre was fixed in the Maximum of the Scale on 14/06/2006 i.e from the date of my taking over as  DM, because I had already drawn all the Stagnation Increments in the Cadre of ADM. Again  Since, I reached Maximum of DM 's Scale   FPA was continued to be paid to me  even after promotion, which I was drawing in ADM's cadre also at AO 's applicable rate, because of my Cadre being AO's  as on 01/11/1993. In nutshell I want to say there is no change in my Basic and FPA in the pre-revised Scale for the Last Ten Months prior to date of  my retirement.   

                              Sir, the period of Ten Months prior to Retirement  falls in Two Categories. First Four months period  falls under pre-revised regime and Last Six Months fall under the regime of Revised Pay Scales. Now, if we proceed to take the Average on the basis of Old and New, there will be huge difference in Calculation of Basic Pension. Earlier, while basic pension was calculated on my Retirement Date based on pre revised scales, Last Month's Basic+ FPA was exactly equal to Average of Basic+FPA for last Ten Months.

                                 Kindly have a look and let me know what should be the correct Interpretation. I am sure the Revision of Pay Scales are done not to penalize and in fact in revision is mainly Merger of Basic and DA and Fixation of Salary is done on the Basis of Basic as on the date of Revision and for calculation of Basic Pension taking old Basic for some period will amount to heavy Reduction of Basic Pension,so arrived at , when compared to Basic Pension  calculated on the basis of last Month's Figure alone . This reduced Figure of basic pension, so arrived at will affect a lot, while calculating Commuted Value.    

                                   I think you have followed me what I want to convey. If , you desire I can furnish exact Salary particulars  to you. I know, you must be busy now a days. Please take your time to study this matter, because it is going to affect all, who retired after 01/08/2012 before completing Ten Month's period i.e between  01/08/2012 to 31/05/2013. I do not know whether there is a clarification from CO on this matter, which is going to create another ANOMALY, if not properly interpreted and Idon't find any Logic behind taking TEN MONTH's Average  for this purpose.

                                I would be happy to know more about you .

            Thanks for sending the detailed calculations for arrears of wage revision, difference of Gratuity,CV and leave encashment payments. And above all Revised pension calculations. When I checked the old payment of leave encashment with your calculation, there was slight difference due to DA not taken for the last salary paid through an oversight.
           I once again extend my warmest regards and thanks for extending so much help to retired/in service colleagues through your blog also

Subbaraman AV: now only 14 days are left for our final battle in sc on 20 01 2016. now the case managers and counsels would have finalised their strategies to fight in the sc.so also the hon judges would have studied in depth the affidavits of both the parties and come to a decision.the arguments and counter arguments it would be only a formality.our counsels should not allow any more adjournments and press for final verdict.i hope a favorable judgement will be given.all is well that ends well.

BRMehta: I am simply surprised the way a few of our learned friends think and communicate on your blog by telling us that Supreme Court will only hear arguments on Jaipur High Court Judgement.Means Civil Appeals against Chandigarh and Delhi High Court Verdicts filed by LIC have been deleted or Advocates engaged by Petitioners at these Two high courts have been told that you are not to be heard. Is it legally possible ? Can Supreme Court Judge pass an order on this line of thinking of our learned friends. Where is

PENSIONERS VIEWS

After going through the posts and counter posts of all our veterans, I understand that  there appears no consensus either on the stand of defense   or on the subject matter. The hon'ble Supreme Court weighs all the prepositions submitted by  both the  parties and then will arrive at a decision. Adjourning the matters from to time to time should be tolerated with  all sense. Not objecting to adjournment may be  considered as lapse on our part but that does mean that our legal representatives failed or attempting to do   something against our interests..At times it so happens. Let us wait and see what would happen in the third week of January 2016.
