After having swept over the prolonged intermediary legal tides, we
have come very near to the winning post. We have cleared all the hurdles
found dumped by miscreants in the path of our undoubted success. Now
our main petition, under top of the board, is listed for hearing on 10th
of March by the Apex Court for its final disposal. All our leaders are
of the firm opinion, sensing the mood and approach of Hon'ble Judges,
that we will certainly secure the final judgment covering all aspects (
100% neutraliation of DA / DR to the pre-01-08-97 retirees, updation of
pension from the eligible date of retirement for all the pensioners,
including family pensioners, with accrued arrears + interest and
disbursement within a time frame, etc.) with nil ambiguity.
Now the question arises whether the Apex Court would come out with all
the above directions on its own accord. No, gentlemen, every thing
depends upon the powerful presentations of our case by our advocates to
the fullest satisfaction of the court. Sri. R.B.Kishore never tired of
advancing his counsels based on valid grounds to be kept thorough in our
side; ( right from the ' Resolution ' passed, recommendation, reminders
followed with secret letters, judgments in the respective benches in
all the three HCs, fate of all the attempts by the bureaucracy through
review petitions, appeals, etc to vacate our main petition, judgments
under Nakara and other cases including the recent judgment of Hon'ble
Justice Dipak Misra on July, last. The recent write-up of
Shri.A.S.Ramanathan about two different judgments on Section 48 ( over
the approval of GOI against the resolutions passed by the Boards )
throws more light over our issues. These are only the least items. The
imagination of our Sr.Advocates should suit the occasions. A reference
to the recent message Sri. Kishoreji summing up the details of our case
will suit the purpose.
Let us not worry too much about the final outcome. Our leaders will
certainly be more cautious over the developments. The Grace of Almighty
is there to protect us.
