Dear Sri GK Notes & Suggestions for Talks with LIC TOP MANAGEMENT---21)This is in continuation of my earlier 1st Bulletin.Time constraint but yet necessary as a loyal worker & activist2)Please discuss with ur colleagues in the Team for talksSri Ivan Rodrigues of Mumbai is a MUSTHe has no email idPLEASE secure 3/4 USEFUL MUMBAI Email ids for our AIRIEF Purpose3)Last Bulletin also will reach you tomorrowGreetings & warm regards to U & all,wishing a very Purposeful & Productive trip & talksRBKISHOREVP,AIRIEF----------------------------------------------------------------------------------------------------NOTES & SUGGESTIONS to RESOLVE PENSIONERS'GRIEVANCES ,ISSUES & COMPLAINTS1)Integration of Overseas Mediclaim with regular existing mediclaim policy shall be welcome as many Elders go abroad, & independent policy,efforts,procedures may not be needed if this is sought to be merged in this scheme.Many have to take recourse to Additional policy, rigmarole of procedures etc & a simple merger with whatever requirements needed, as the insured is known already, can be much simpler & simplified,as an add-on to the advantage of insurer & insured.2)Eligibility for full Pension after 20 years against 33 yearsLIC is very much behind in these overall general matters.One has to go with the favourable wind, especially,when it is mainly administrative & no big bucks philosophy is there.Further,when pensioners badly need some relief & more empathy,enlightened Management must step in & grant relief,when moreso,thinking on such subject has crystallized.Presently,the retirees who had not completed 33 years as on the date of their retirement are , not getting Full Pension, but only a proportionate pension.Due to impractical provision of Rule 27, lot of retirees who joined the services of LIC from Agency quota or on getting relaxation in maximum age at entry, particularly in specialized fields like Engineers,CAs,are deprived of full pension.It has resulted in uncalled for litigations also.Courts have also granted Notional 5 years addition to actual service rendered. However,when final realistic solution & AllIndia thinking has emerged,it is advisable to implement it in LIC too without delay . The aforesaid eligibility condition would resolve the grievance of such retirees & ensure pension benefit AT PAR with others.3)Protection of Last Drawn PayGrievances & complaints ,immediately after every Wage revision have mounted.It is a genuine one ,as they suffer loss & further, their pension gets reduced, when compared to even their Juniors & lesser Cadres too.Many representations to DO/ZO/CO are there.It is a matter of gratification that Govt has resolved, so too RBI ,pragmatically announcing remedy that last drawn pay or 10 months average emoluments whichever is higher be taken as the criterion for fixing pension. This will resolve the anamoly being caused in case of employees who retire within 10 months of Effective date of the immediately preceding wage revision.4)Additional Pension after age 80 yearsSr Citizens & Elders have to be protected,All India Senior Citizens Confederation regularly meets concerned Minister for Pensions, Elders Welfare & on the lines of UNCharter, processes their Memorandum of Demands & announces policy decisions taken.VI Pay Commission ,apart from pension upgradation,granted value-added pension rise for advanced ages 80,85,90, 95,100 to the extent of 20 %,30,40,50 & 100% respectively.This was from 1/1/2006With advancement in age, pensioners are prone to diseases & they need extra money to take care of health.A sizeable amount of pension is eaten away in such illnesses & worries too.It may please be noted that EVEN in 7th Pay Commission, not only higher Multiplier Factor 2.86 times stipulated for pension, BUT ALSO, this Value-added % rise continues.One can very well imagine the sizeable benefit Govt Pensioners shall secureIt is high time LIC,Principal player in Financial & Services Sector ,as an enlightened employer,clears this SIMPLE MATTER as a GIFT to ELDER of the ELDERS to earn deserved praise from fraternity of pensioners during thisDIAMOND JUBILEE YEAR of LICALSO, for ALL PENSIONERS as a DJ GIFT DOMICILIARY CASH ALLOWANCE YEARLY &PREVENTIVE HEALTH CHECK UP ALLOWANCE, as a matter of Holistic health & living as a DJ GiftIt may please be remembered while employees & even then recruited got a Golden Jubilee Gold Coin,after a Rajasthan HC case ,only Rs3000 cash award was given to pensioners.This is not fair.If only Management realizes how poor pensioners were ,not only in terms of Quantum of Pension, but Total Retirement Benefits now a Bonanza & then measly & a pittance indeed,where to save & what to invest, PLEASE feel the pulse & gravity of financial situation for those who rendered valuable, glorious services against odds & transfers & other imponderables& made this Institution a glittering one.Management must go out of the way to lend a helping hand to them deservedlyR.B.KISHORE, ED(Retd),LIC, VP,AIRIEF3) Dear Sri GK, NOTES & SUGGESTIONS FOR TALKS ON PENSIONERS PROBLEMS with LIC TOP Management ---31)I attach the Notes for talks with LIC Top Management on 29/2/2016This Series 3 is the last oneIt took me a lot of time to cull out & present the problems in good shape2)We are aware of time, how management responds, how forceful we present,more so as it is DIAMOND JUBILEE YEARSo, do ur best with AIRIEF Team & try utmost for SELECT issues to be resolved with some deadline & positive assurance3)Anyway, it was full time for me to recapitulate, simplify, & overall ,this can also form a sound Base for Future Followup, which is the most important & in which we lag behindGreetings,goodluck & Godspeed,RBKISHOREVP,AIRIEF-------------------------------------------------------------------------------------------NOTES FOR TALKS WITH LIC TOP MANAGEMENT 29/2/2016 MD, EDP & others—Series No 31) Many High Courts have given unequivocal verdicts that those who retired under VRS or who resigned are eligible for Pension.Even MOF/GOI in Bank 2nd Option for Retirees have clarified to IBA to correct their erroneous views & grant pensionLIC must open up such cases & graciously settle pensionary benefits which they indeed deserve.2)PENSIONERS ' PORTAL is pending for many years now.We sent very useful 4 page suggestions in 4/2012,We followed up with CO.Except that the assignment is handed over to an External Agency,though 4 years have rolled by, it is sad PORTAL is yet to see the light of day.We have outlined many utilities .PP must be a blessing to pensioners. All relevant data of pensioners must find a place for pensioners to click with User Name ,get to know the pensioners world, meet other pensioners, as address will be available,Mobile No will be there.instead of isolation at Old Age,Socialisation can take place,reduce anxiety & frustration.Above all, as all facets of pensioners domain of responsibility will find a place, pensioner can check up Pension, DR, Slabs, IT Rules, Mediclaim premium, Forms to be used to download, Dos & Donts for Pensioners, Data of pensioners ,TPA website, Exgratia retirees position,Important Telephone Nos etc for contacts to resolve any problem,Nodal Officers Name, Designation, Address,Mobile No, Email id etcIt is felt impetus & sense of URGENCY must be instilled & PP inaugurated before 1 September 2016.We requested the nomenclature should be PENSIONERS' PORTAL, not PENSION PORTAL as was earlier suggested by CO3) LIC Golden Jubilee Foundation is doing a stellar service to society, policyholders etc.As part of CSP,Corporate Social Responsibility,objectives of advancement of education,medical relie,relief of poverty,& any other object of general public utility are laudable.It appears Chairmans Relief Fund is withdrawn. Those afflicted with high-end diseases & treatment like chemo-therapy,dialysis7 radio-therapy ,where limits prescribed deter payment of full insurance SA,as 20 % of SA restriction is imposed adversely affecting such pensioner patients needing long & continuous treatment.One can well understand the agony & frustration & money to be spent continuously.PLEASE help us by allotment of some decent amount or cases to be referred to CO with data by DO/ZO etc so that genuine requests are entertained ,making their lives a little merrier & bringing credit & glory to LIC GJFIt will be ideal gesture if LIC can start offering Scholarships to BRIGHT ,deserving wards of pensioners4)Pensioners so far do not have any worthwhile benefit specifically to promote welfare PSBs have such Welfare Fund,subject to a cap of 3% of Net Profit,with SBI enjoying then a ceiling per year of Rs100cr.When MOF/GOI DFSissued the circular in Feb 2012LIC can earmark higher amount ,catering to PensionersWelfare as Employees will come under various other benefits & privileges offered or showered on them.5)Somehow, with initial euphoria ,LIC Care Homes subsidiary started with noble objectives looks to wear a low profile.Indeed a wealth of goodwill can be earned if only proper planning, execution, amenities, are provided ,with appropriate utilities & architecture suited to concepts earmarked & propagated.Time is ripe in view of fast changing societal shakeups,parents alone, Sr Citizens need care,they are in search of serenity,calm surroundings,with all amenities at affordable prices with adequate healthcare facilitiesPlease consider expanding fast to other Metros, Tier I Cities where Other organizations by any name go for the kill ,fleece elders & make a mockery of original spelt out Mission statements.Policyholders,pensioners & many others badly need LIC intervention as a symbol of quality & trust & welfare,where LIC is the byeword.6)LIC can thoughtfully adopt a few Old Age Homes,where Social audit has taken place, LIC of its own can also do such audit ,select few such Homes & offer to pensioners as priority of such wellmanaged homes with good infrastructure & holistic living.7)i)Conferences of OS Dept at All India level strangely do not contain ZO wise,DO wise Data of Regular Pensioners, Family Pensioners,Exgratia, Spouse ofExgratia,Child pensioners etcShocking it takes months & years to fup & get.There must be Regular automatic feedback on ALL matters of OSDept ,even if impinging on PER/ER with proper coordinationWhen RBI Dictat is implemented for direct credit of ALL Payments thro NEFT ,even Claims LIC credits direct EVERY month such statement is received at DO/ZO/CO.Then why Mly statements of pension payments are not analysed for errors or improvements.ii)Noone knows whether TPA has issued Laminated ECards.SZ got the earliest thro Vidal Health services in July 2015 end. SCZ has started getting last few days.Ecards of TPA &Photo Identity Cards of LIC together become necessary for CASHLESS service for Preauthorisation to verify OSA chosen by Pensioner etc8)CO Circular conveying higher OSA of Rs 25 lacs & 30 lacs can be opted before 10 Mi)arch 2016 ,but without Premium rates or approximate indication, many queries we get,what pensioners can do if premium is found to be costly or prohibitive.Clause of consent is binding & irrevocable,that is improper, unless provision to revoke is offered.Last time for all OSA detailed Tables & Charts were provided to enable all to choose rightly upto Rs 20 lacs.Such could have been done after hastening & concluding talks with New India on an urgent basis. (CO CIRCULAR dt 26/2/2016 JUST RECEIVED )9)CO must arrange periodic interactive meetings with New India ,TPA, Representatives of Employees & Pensioners to understand working, progress, issues & grievances, repudiation & curtailment of claims without assigning any reason etcSuch meetings can be held at ZOHqrs too & at DO levels also for closer,wellknit personal touch & fuller grasp & understanding of problems10)i)It is sad to know that there are many cases where Nomination is not done for O/S pension,family pension, or mediclaim amount or any unclaimed benefits of pensioners.Proceeds must go to earmarked relatives. Getting into legal requirements is a tangle & time consumingPer/OSdept must strengthen basic pensioner services as also value-added services.ZO/DO can provide such open items where title is NOT taken care of,inform pensioner & also send to ZO/DO President, GS of pensioners Fedn & in their own way, they will lend a helping hand to avoid laterday problems.CO has to issue such Circular to enable ZO/DO to keep records clean with qualityii)In some Offices,we find unclaimed Photo IDENTITY Cards are still lying.Sure some Quality control steps could be takeniii)Death of pensioner is a sad event. Widows/Family are not aware of any procedure or how to fill forms.Even SR No they may not know.Please give us a LIST of such pensioners with particulars of date of death etc .Forms for FP settlement atleast we can offer & enable them to settle down in the hour of grief11) i) Earlier the retired employees/officers, were harassed for anonymous and frivolous complaints. With long struggle, Ministry of financial affairs issued instructions to all the financial organizations, amended LIC Staff regulation Sec 39 and also Pension Rules stating that,"No disciplinary proceedings, if not initiated while the employee was in service, shall be initiated in respect of a cause of action which arose or in respect of an event which took place more than four years before such institution".Relevant instructions/circulars are..1. Notification in Staff Regulations 39 rule Sub (4), clause 4b of LIC Staff Regulations 1960,2. Rule 48 of LIC Employees' Pension Rules, 1995, and3. LIC's own circular Ref personnel/ER Dated 30th July, 19964. 'Initiation of disciplinary proceedings' has also been clearly clarified as 'issuance of charge sheet' only.But it has been observed that office note at Per/ER, C.O. are prepared in contravention of these important circulars and accordingly the charge sheets are also got signed even from Chairman. When challenged, they try to misinterpret the instructions saying,"it is observed that the charge sheet has been issued within 4 years from the cause of action that arose when the irregularity came into the notice of disciplinary authority and explanation was called from the CSO."
In fact the four years period is to be reckoned from the date of issuance of the Charge sheet and not from the date when the irregularity came to the notice of the Disciplinary Authority. CLARIFICATION VIDE CO CIRCULAR DATED 12.02.1998( attached)
Very purpose of the instructions was to protect the employees from unnecessary harassment after retirement. The date when the event took place is only relevant and not when it came to the notice of DA, is the spirit of circular.
This wrong need to be brought to the notice of the Chairman. If LIC would not listen to the reasons, employees would be compelled to seek justice from the court and it would be embarrassingii) This is with regard to withholding of retirement dues, particularly gratuity and commutation of pension." Page 228 of OS Manual – last para says, 'Ref: Cir no zd/952/ASP/2000 dated 04/05/2000 Deptt Personnel/ER.'However, where no charge sheet has been issued to a retired employee, then in such cases the office cannot withhold the settlement of gratuity and the commuted value of pension'.Even if a decision is taken for withholding of retirement dues, amount withheld should bein accordance with the extent of contemplated financial loss to the corporation.CVC of the country has also directed to all the officers working in PSU's vide its circular 003/dsp/03 dated02/05/2014, for a reasoned and speaking order with proper application of mind.But sorry to say that here again, decisions to withhold retirement dues are not taken with reasons.Two live cases from our zone where LIC ab initio, concluded that there is no financial loss to the corporation, still entire amount of gratuity was withheld.R.B.KISHOREVP,AIRIEF 27/2/2016------------------------------------------------------------------------------------------------------------RB KishoreVP,AIRIEF,ED(Retd),LICLife Member,Probus Club044-2815 5810 & 098 4034 0591.
