The Madras High Court Bench here has held that a retired Thalaiyari (
Village Assistant ) is entitled to commutation of pension from the date
of his initial appointment even if it was on a temporary basis and not
just from the date when his services were regularised.
Allowing a writ petition, Justice T.Raja directed the State government
to refix the monthly pension of the petitioner, K. Gopinathan of
Kanykumari district, from July 1975 when he was appointed on a temporary
basis and not from July 1995 when his services were regularised.
In his affidavit, the petitioner stated that he took voluntary
retirement in 2010 citing personal reasons. Then, his pension was
commuted by taking into consideration the service rendered by him only
from 1995 and by ignoring around 20 years of hard work put in by him
before that.
Finding justification in the petitioner's grievance, the judge recalled
that in 2009 itself, a Division Bench of the High Court had placed
reliance upon the Special Rules relating to Village Assistants and held
that temporary service rendered by them should also be taken into
account.
